Because TPTB WILL Shut down your regular communications in any event they don’t like, or if the local Natural Disaster (be it hurricane or earthquake or fire or flood or…) is bad enough, nature may do it for them.

So here we have Tousi TV showing ongoing “People in the Streets” all around Iran, even as “Comms are down” officially. Plus he knows that his reporting is getting back into Iran (my guess would be via StarLink but even “sneaker net” delivering USB drives or “Pirate Boxes” with hard drive copies and local open Wifi can do it…). Even one person with a Satellite phone can download it, and them share it via Mesh Networks…

You just can’t stop the signal anymore.

Murder has a well-established definition, and just being with someone who dies during the commission of a crime doesn’t fit any classical definition of murder.

It defies common sense. It’s like an ‘ends justifies the means’ law. They want god-like power to punish anything they don’t like, and so they make up circumstances and shoehorn them into the most serious crimes possible, in order to punish people they don’t like and silence opposition through fear.

It’s the pinnacle of anti-American.

In America, the punishment has to fit the crime, and the crime has to be real and legitimate, not made up by politically motivated lawyers to punish their enemies — which is all hate-speech crimes are, too.

If two brothers commit a bank robbery, and one brother is shot and killed by police during the robbery, it makes zero sense to charge the surviving brother with murder.

He didn’t compel his brother to be there (brother had free agency), he didn’t pull the trigger (no overt act by surviving brother is the cause of death), he had no motive, he had no intent

And most important of all, he didn’t DO it.

The cop shot and killed him, not his brother, which is not even contested. So it is a perversion of justice to prosecute the brother for murder, when no one even contests that the cop shot and killed the deceased brother.

So everyone knows who killed him — and it wasn’t his brother — but the state is going to prosecute the brother for a murder he didn’t commit, anyway?

So if the brother is convicted, then TWO people killed his brother, and the person who actually killed him goes free — because no crime was committed by the cop — and the person who didn’t kill the brother is convicted of murder. Even though he didn’t kill his brother, didn’t intend to, and didn’t want his brother to die.

And this is called ‘justice’.

The brother can be charged with enough legitimate crimes to put him away for 30+ years, including felony armed bank robbery, potential hostage-taking, etc.

But in what sane, rational, lawful justice system is the surviving brother prosecuted for the murder of his own brother — who he didn’t kill, and who he didn’t want to die?!?

I see this entirely differently. There are certain criminal behaviors that are exceedingly dangerous because they are well past legal norms — home invasion robberies, for instance, or terrorist attacks. While someone may delude themselves into thinking “my part in this is miniscule and harmless”, the entire operation is so lawless that any contribution towards its aims wraps the perp into the crime.

Police catch him and charge him with breaking and entering, armed burglary, conspiracy to commit armed burglary, home invasion, probably unlawful possession of a firearm (another felony), reckless endangerment, and there must be a dozen more actual crimes the perp actually committed.

Enough to put him away for life, if the sentences are to be served consecutively.

You have just stated why the law exists! The law IS the fix for ambiguously attributable deaths during crimes. The alternative is probably worse – and that would be to statistically distribute the punishment into all crimes that might result in deaths, a calculated number of times, depending on the crime. That results in less individual justice overall.

The fix for “accidents” and “we’re all dindus” when something bad and hard-to-assign-responsibility happens during a serious crime, is the “felony murder” rule.

The rule is that when a dangerous situation which results in a hard-to-attribute death is created, the death is attributed to the people who created the dangerous situation. It’s very “Trump doctrine”, IMO. “You all broke it – you all pay for it.”

But it’s not hard to assign responsibility, not in the example of two brothers that I used.

The brother who was shot and killed had responsibility for his own actions, and he paid the ultimate price.

The crime was committed, and the price was paid with the brother’s life.

Now the State wants to make another person pay for a death that isn’t a crime, and we know it isn’t a crime because the cop shot the brother dead in the line of duty. No murder took place, only a justified homicide.

But now prosecutors fly a ‘murder’ charge in from nowhere, and charge the surviving brother, who had nothing to do with his brother’s free agency or his brother’s death which resulted from his brother’s free agency.

The surviving brother had no intent, no motive, no malice aforethought of any kind toward his brother.

Murder requires intent.

Negligence doesn’t, manslaughter doesn’t, but murder does.

There is no intent in the example of the two brothers, so the State just literally makes it up, and calls it ‘constructive imputation’.

Let’s make the example even clearer.

The two brothers are safecrackers. No history of violence.

They break into the bank in the middle of the night, with safecracking tools, no weapons.

A patrol car drives by, notices something, and stops to investigate. Catches the robbers in the act, and one brother makes a run for it.

The cop shoots him dead and arrests the surviving brother.

Prosecutor charges and convicts the surviving brother with murder, just because he can.

Now you have a non-violent criminal in prison for life, convicted of a crime he literally did not commit, while there are 10s of thousands of actual rapers and murderers out on the streets who served little or no time.

That’s not justice.

You are correct – “felony murder” isn’t murder – it’s responsibility for creating a situation that led to an unnecessary homicide. It doesn’t require intent. It is punishing what is inherently reckless conduct at a minimum.

It’s the NAME “felony murder” that’s wrong, TBH. It should be called “felonious conduct leading to homicide”. That is what people are responsible for, and that is what they are rightfully convicted for. It obviously can’t carry the death penalty, and compared to any level of direct homicide, it’s going to be less – but it’s a real thing.

“Felony murder rule” does not equal “Felony murder” – and it’s a really unfortunate name.

Also, in your cop case, you are assuming that the cop’s conduct is justified – it’s likely not, IMO. The COP would likely be charged for shooting a running non-violent safe-cracker. The cop, if culpable, would be charged for his direct offense – probably some kind of manslaughter. The other perp would only be charged for – as I said, helping to create a situation that led to an unnecessary homicide, no matter how it happened.

I used to be of the same mind as Scott – that the very idea of “felony murder” was bass-ackwards and unprincipled.

Eventually, I came around to what you stated here.

One way to see this, is to replace the shorthand name “felony murder” with “engaging in a felony which results in death”. That is what the charge is, that is what happened, and it makes legal sense. Like murder/homicide, there is a range of responsibility, from mere carelessness to premeditation to brutality and inhumanity.

A great example is a burglary in which a homeowner accidentally shoots themselves or a family member. “Chalking it up to an accident” – we know in our hearts – is bullshit. The criminal negligence of creating a situation in which mayhem unfolded, needs to be punished by the law. But instead of calling it “criminal negligence of creating a situation resulting in homicide” – we just call it “felony murder”. After that, a jury can decide if the level of culpability by the criminal is sufficient to say “this wasn’t just an accident – you go to jail.”

Note that misdemeanors cannot result in the charge, which means that it was a serious criminal act resulting in death – not bumping fenders and exchanging words or shoves in a parking lot.

The burglar should be held accountable, and the length of his sentence should reflect that accountability.

But to put him into the system as a ‘murderer’ isn’t rational.

A murderer, someone who takes another person’s life, with premeditation and malice aforethought, is a very special kind of animal.

By contrast, someone who is indirectly responsible for another person’s death, someone who had no intent or premeditation and who didn’t personally kill anyone, is a completely different kind of person.

The first kind kills without conscience.

The second kind might not ever have used violence against anyone in his whole life.

The two are not equal threats to society, the crimes they commit are not equal in nature.

The length of sentence might be justifiably the same, but if we had to be in a room with one of them, I bet we would all choose the one who didn’t commit premeditated murder.

I think this is where reporting in general has failed us. To equate the “felony murder rule” with “murder” is obviously wrong, but “perps is bad”, so the inherent tension of journalists presenting “felony murder rule means murder” makes the internal contradiction juicy enough to automatically stir up interest, as most people haven’t even heard about it.

“Death becomes culpable by the very fact that it originates in an avoidable crime” is a brilliant legal concept, IMO. The next concept which should be added is “Felonious culpability is not to be confused with direct culpability, which is greater and different.”

That concept appears all the time in sentencing, when multiple parties are involved in a murder. The person who pulls the trigger ALWAYS gets a huge sentence, if not the biggest, because they made the final choice. The person who HIRED, SEDUCED, CONVINCED or COERCED the killer, may get a comparable sentence, depending upon the level of intent and persuasion. They, too, are guilty of murder – but sometimes it’s just yelling “Drive, Baby, Drive” and the cop can’t get out of the way.

Arun Subramanian is a United States District Judge serving on the Southern District of New York who just issued an injunction to force the Trump administration to hand over our tax dollars to support fraudulent daycare centers all over the country. 

He was appointed by Joe Biden in 2023. 

He issued an injunction knowing the states don’t have a snowballs chance in hell of winning this case. Federal courts cannot force the Executive to disburse funds on a particular timeline absent a clear statutory command. 

And there is no clear statutory authority to disburse funds immediately to daycares absent a thorough review. 

So this judge issued an injection forcing the waste of taxpayer money in a case he knows the states won’t actually win on the merits.

God will certainly hear prayer: David gives to God the glory, and takes to himself the comfort. (1-6) He prayed for himself, that God would guide him, and for all the Lord’s people, that God would give them joy, and keep them safe. (7-12)

1-6 God is a prayer-hearing God. Such he has always been, and he is still as ready to hear prayer as ever. The most encouraging principle of prayer, and the most powerful plea in prayer, is, to look upon him as our King and our God. David also prays to a sin-hating God. sin is folly, and sinners are the greatest of all fools; fools of their own making.
