2025.09.09 Daily Thread – American Stories: When in the Course of human events – Part 26

We move to neighboring New York to begin the next reveal of the remaining Declaration signers. So let’s open with some famous New Yorkers and NY related songs to get us warmed up. There are Goober Gump sightings in this one.

OK, went back in the time capsule for that one. In fact, I saw him in concert in Vegas a few years previous to this performance. Yes, I’m old.

Let’s go with a more current NY music entertainer, albeit a now older guy who is having his own health issues and stepping back from the limelight.

Well, now that you asked, I also saw this guy in concert in 1973; the year Piano Man came out following the Cold Spring Harbor Tour. He excitedly announced on stage that the song was going to be released in about a month along with a planned album later. The response from the thousands in the crowd after hearing the song was like thunder. As we now know, that song is timeless Americana that will be forever associated with Billy Joel.

Then there was the following New York bred music entertainer, Harry Chapin, that some may know, or barely remember, or may not know at all . Yup, saw him the same year. Hands down one of the best concerts I have ever seen. He held the crowd in his hands with his stories, humor and talent. His brother, Tom, sang the high female voice part. Tom also did a cool Saturday morning children’s TV show called Make A Wish that won an Emmy. He played six instruments in the band. In addition, Harry’s bass player was the baritone voice heard as Mr. Tanner in the song of that name. That song was based on a real person and event with the actual name, location and occupation changed to protect the described person. Years later the person learned about the song and was very happy that Harry had remembered him.

Harry’s life was cut way too short at age 38 in an auto accident on the Long Island Expressway. So, here is one in his memory…

However, as much as I enjoyed and was musically influenced by the NY entertainers above, the following expresses my personal thoughts and feelings about New York itself. That is not a slam to the many fine people who live in the state or some of its more beautiful environment. It is directed at just how far the state in general has strayed from its founding and service to America. That has led to the virtual destruction in the quality of life one should expect. I will address more of my thoughts on that issue in a future part.

Yeah, as he toured the south I saw this Philadelphia area singer songwriter, Jim Croce, who would not be recognized by many as a classically trained music student at Villanova as a young man. Yes, the concert I attended was in that same year. It was held less than two weeks before his plane went down with his bandmates traveling to a concert in Louisiana and he was lost to all of us. What the world did not know at the time was that he was choosing to give up his promising entertainment career to write short stories and movie scripts. While on this last tour he had written his wife a letter describing his decision. It arrived after his passing.

We never know as we wander through life what is in store. Time to get busy.

New York Revolutionary War Militia Involvement

The following in the link below is priceless for historians and genealogists as it was published in 1904 and archived by the State of New York’s Office of the Comptroller. It contains documents and records from the Revolutionary War period in the state that includes names of militia members in every regiment and area of service. I found it interesting, especially the fact that the Comptroller at that time documented the fact that NY provided more than double the number of military members during the Revolutionary War than credited by historians up to that point. The two figures are starkly different at 17.8 K officially versus 43.6 K with this revision. Yet, another proof that history and narratives are frequently wrongly stated. Readers should keep that in mind when trying to learn more and should not take statements of historians as gospel without first personally investigating and consulting numerous sources.

So why is this adjustment important? It is hardly surprising that Massachusetts earned the honor of having the most members in our military. But few might know that with this documented revision that New York would be second on the list. It gives readers an indication of the commitment of the residents in each state toward the cause of liberty during the period. You learn that NY’s involvement represented approximately 20% of the total estimated participation of 200,000 men give or take. Even with the information provided there is cause to believe there were a great deal more men involved in the conflict based upon the records of pensions granted to members who were injured in the conflict whose names do not appear in any other records, indicating the original enlistment records were lost. Such is the case with NY.

Included in the first 25 pages or so of text are descriptions of war efforts, battles, conflicts with Indian tribes who were stirred up against the colonists by the Brits/loyalists, pay, rations, service requirements, attire, weapons, training and so forth. This quote was also very interesting – “Quakers, Moravians and United Brethren were enrolled, but exempted from service upon payment of money, which varied in amount as the war progressed until, in 1780, they were obliged to pay £160 per year.

So some could legally buy their way out of serving. I guess money was tight and patriot lives were cheap for everybody else.

Another interesting quote relates to slaves – All slaves ‘killed in the service were to be paid for. In time of invasion, any slave, not in the military service, found one mile from his master’s abode, without a certificate from his master showing his business, might be ” shot or otherwise destroyed without fear of censure, impeachment or prosecution for the same.” In 1781, it was provided that any slave who should enlist and serve ” for three years, or until discharged,” should be declared a freeman of the State.

That might burst some holier than thou bubbles.

So, even if I am not a big fan of New York today as the state has clearly lost its way for quite some time and still creates millions of slaves of a different sort, I salute the commitment to the patriot cause of its forefathers. We will now turn our attention to one such Declaration signer. As we will learn, the cause of liberty was met with challenges, violence, death and misfortune for many; which included some of our founding fathers who we celebrate and thank today.

Phillip Livingston

Phillip Livingston was born in Albany, NY in 1716. He was the fourth surviving son of Phillip and Catherine Van Gogh Livingston. His father emigrated from Scotland and mother was Dutch. His father lived in the Albany area in 1673 and later owned a large rural estate as a 2nd Lord of the Manor, some 160,000 acres located along the Hudson River about 40 miles from Albany. He received the estate for his faithful service to the Brits in political appointments such as Secretary of Indian Affairs, in his fur and other trading activities as well as in his close associations with the Dutch due to their family’s background and ability to speak both languages. This established him into the aristocracy of the region and the estate was granted him by the royal governor for his efforts. The manor later became known as Clermont and was held by seven generations of the Livingston family until the year 2000. A photo and link about them and it is below.

Young Phillip spent his time between his father’s Albany townhouse and the estate. He went on to Yale and graduated in 1737 before returning to begin a mercantile apprenticeship under his father. He served in clerkships in the Albany government before moving to New York City to begin a career in the import business trading in the West Indies. He was very successful through the years that followed and became wealthy. He made much money providing British military provisions, slave trading, and privateering. For those who do not know what privateering is; it is a government authorized form of pirating. The privateer was authorized to violently attack shipping interests, usually foreign, to seize the cargo on behalf of the government. They would split the goods and/or profits. In 1740 he married the daughter of a British Colonel, Christina Ten Broeck. They went on to have nine children together.

Phillip gave back to the region with his finances and time. He advocated for the founding of a school that is now Columbia University, for a Professorship of Divinity at Yale, helped in the building of the first meeting house for the Methodist Society of America, and helped organize the New York Public Library. He then entered public service as a New York City alderman. He served three terms on its Provincial Assembly. He was slow to join the independence movement, but over time he saw it as the right way as the oppressive British tax acts began accumulating. He was adamantly opposed to taxation without representation as he still considered himself to be a British citizen accorded all rights of the nation. He would be elected or chosen to positions within the Provincial Assembly only to meet British opposition and removal. Eventually, in 1769, the royal governor dissolved the city’s Assembly.

In response he became a member of the Committee of 51 that chose him as one of five delegates from the state to attend the First Continental Congress in 1775. At the same time he served as President of the New York State Provincial Assembly. He signed the Olive Branch Petition to try one last time to move the King away from his push for more control and taxes in the colonies. The King refused as we know. This led to the Declaration of Independence, which Phillip approved and signed on behalf of the state.

As a person Phillip could be gruff and irritable at times in his political and business dealings. However, he was known to be very kind and loving with family and friends. He was reserved and spent a great deal of time reading. He was a deacon and elder in the Dutch Reformed Church throughout his life.

However, like many wealthy mercantilists during the era he participated heavily in the slave trade and personally owned some for a number of years. There is a report that indicated he was involved in at least 15 shipping transactions of hundreds of slaves that were brought to the NYC area for sale. As another example, in one article there was discussion of him advertising and offering a reward for the return of his property, a slave who had escaped. This bit of history and other slave trading related accounts have often been deleted or glossed over in the many historical accounts of Phillip as well as other northern founding fathers.

I must interject here as I find what has been happening with the rewriting of history to be tragic. This series has been a real eye opener for me. There is no call for this type narrative based rewriting of history that I am seeing repeatedly. In my view it means the rewriters have ulterior and probably nefarious motives to do so. In regards to the subject of slavery, what was an acceptable and legal practice during that period in time is no longer so. Just observe, recognize the truth, and move on. Chalk it up as a wrong that has been righted.

The Livingston extended family were prominently involved throughout New York state and colonial government. Phillip’s first cousin, Robert, was even appointed to Chancellor of New York State, its highest judicial office. He was a framer of the Declaration of Independence and later administered the oath of office to George Washington as President. He served as Minister to France in negotiations for the Louisiana purchase in 1803. We must note that he and the other American negotiators figuratively struck gold on that one. Some twenty Livingston kin of Phillip served as officers in the Continental military. The family was patriot to the core.

Both Colonial and British forces occupied two of his homes in the city at various times, First, Gen. Washington used one as his headquarters before the colonists lost battles around the city, at which time the Brits used it to house military members as well as his second home as a hospital. Phillip and his family fled from the fighting to their home in Kingston, NY. When this happened his slaves escaped and some were thought to have joined the British forces to later earn their freedom. The Brits eventually burned all of the town of Kingston to the ground. The family escaped again back to the safety of their native Albany area.

Phillip was chosen as a state senator while remaining a member of the Continental Congress. In fact, he served up to the actual day of his death while working in the same assembly in 1778. He died from the long term effects of dropsy (edema) at age 62. Members of the Continental Congress attended his funeral and there was an official one month mourning period. He is buried in Prospect Hill Cemetery in York, PA. The prominence and dedication of both Phillip and his cousin, Robert, are noted with several memorials in Washington, DC. With the British destruction he had lost most all of his properties and holdings while still having debts owed from his estate. The sale and repayment took nearly 25 years to resolve. His wife, Christina, remained in the Albany area surrounded and cared for by family for the rest of her life. She lived to the age of 82.

Phillip Livingston gave all he had for his country, family and friends. His family legacy was faithfully served by his efforts as well. We have great appreciation for this patriot founding father.

A few weeks ago we were talking about the imminent end of Windows 10 and how some of us would have to get new computers, since our old ones couldn’t upgrade to Win 11. Well, a couple of weeks ago I took the plunge and bought a refurbished computer off eBay. I maxed out the ram at 32 GB and chose a very fast SSD hard drive. It came installed with Win 11 Pro. Total cost: $208. At first I really didn’t like Win 11. But after I started making some changes, like moving the task bar over to the left where it belongs, and cleaning out all the Microsoft junk out of the task bar and the start menu, I realized that it’s not all that different from Win 10. And on this new computer, everything is super fast!

The next problem was getting all my programs off the old computer and installed on the new one. Documents aren’t a big deal, as they can just be backed up and installed on aonther computer pretty easily. It was my programs I was worried about. I did a little bit of research and found a program called PC Mover that would move all the documents, settings, and most programs over to the new computer without them having to be reinstalled. I decided to try it, since I’m not sure I could even find some of the original installation disks for some of my programs. If you buy the version on Amazon, it comes with a data cable that plugs into a USB 3 port on both computers. It also lets you configure exactly which documents, settings, and programs you want to move. Once I did that, to my shock, it moved everything over in 44 minutes.

I opened the 2 browsers I use – Firefox and Brave – and found that the same open tabs I’d last used were open. And all the various configuration changes I’d made were still there. I opened the text editor I use to keep notes on various subjects, and all the same files were open that I’d last used. All the things I’d pinned to my old Win 10 task bar were now pinned to my Win 11 taskbar, I was really impressed! The last time I had to move stuff to a new computer, it took days to get it all moved and everything set up the way I wanted it. So I very much recommend this program for anyone who is going to have to get a new computer and make the move.

And since Coothie and others have suggested using this as an opportunity to try Linux, I decided to do that with my old computer for fun. So today I installed Zorin OS to my old computer and am making this post from Zorin. I haven’t had much time to play with it yet, but it looks like it already has programs to do just about everything I did on my Windows computers. And it has a user interface that is very similar to Windows, so that will make it easier for me to use. I could actually see myself using Zorin as my daily driver, and I never thought I’d ever get into Linux in any form! Anyway, I thought I’d share my experiences in case it might help someone else faced with the same dilemma with Windows.

Congratulations all around!!

A couple of notes.

Windows 11 is full of Microsoft spyware, even more than Windows 10. Keep offline backups.

Linux generally has a firewall in your install…..but it is not necessarily turned on. Make sure to “sudo ufw enable” to have it turn on (and it will turn on again whenever you restart your computer).

The Fiancee infuriates me by not keeping her Linux system updated. You don’t have to be fanatical about it, but anything past once every 10-15 days is looking for trouble.

Most “Windows-like” Linux systems are closer to Windows 7 than Windows 8 was.

Brave is available for Linux — just go to brave.com for downloads and instructions. I assume it came with Firefox. Most security breaches tilt your browser, so you may want to uparmor Firefox. I prefer to have three browsers available, so I also loaded Vivaldi.

Actually, it came with Brave already installed. I think they recently made that change because Brave has more privacy. I did check the firewall and it was already turned on. After I installed it and set up the network settings, I looked through all the settings. I hear you about the updates. I’m guessing they’re not automatic like Windows. I did have all the current ones installed while it was installing the system, so I should be up to date right now.

In Windows, if you’re running something important, you have to plead “don’t update, don’t update, don’t update” and it might update anyway and lose your work. By contrast Linux will generally just say “updates available” and let you start them at your convenience.

By the way, you can thank this guy — https://en.wikipedia.org/wiki/Brendan_Eich — for the solid security features of Brave. Since he invented the javascript language, he knows a bit more than the average bear about its security weaknesses. If he says Brave is secure, where would I go for a second opinion?

Zorin is based on Ubuntu, so you have a solid base that is well-managed.

A few days ago Ubuntu, which is usually rock solid for updates had a failure at the main servers. That was resolved pretty quickly but the problem was that it propagated out and THEN a huge avalanche of clients began to try and get updates … About then I tried to update. I knew something was wrong when the download rate was 38B/s.

It’ll nudzh you whenever you open it.

The typical routine for updating is very easy, but each piece does something (that you may want to do differently).

You pop open a terminal window, and type in “sudo apt update && sudo apt upgrade”. When you hit return, you’ll be prompted for an authorization password (which is your usual login password). The “update” part looks at all the software out there and builds a little database. “Upgrade” checks all of your software against this database to see if it is current. It will then tell you which packages it intends to upgrade and the total amount of space needed — if that number scares you, you can say “n” to abort and try to figure out any issues. If, instead, you say “y”, it will start doing the upgrades.

When it is done with this update/upgrade process, you want to do “sudo apt autoremove”. If two of your packages once needed “blortlib2.4” and one now needs “blortlib2.5”, a normal upgrade will add “blortlib2.5” and simply keep both…….but if both of your packages now needed “blortlib2.5”, then “blortlib2.4” would become an “orphan package”. The autoremove function finds all the orphan packages and deletes them. It will also list its victims and total file size before giving you a y/n option.

Finally, apt defaults to keeping a copy of every package you install, in case you have to reinstall or reconfigure it. With fast internet, nobody does this any more. Using “sudo apt clean” gets rid of superfluous installed package copies.

This is why Linux never caught on.

I deal with my Mom’s inability to complete even the most basic tasks on a regular basis.

I am conditioned to see everything from the perspective of “How can I make this task or tool or event so child-proof that my Mom can do it”.

What you listed above is certainly easy if you’re used to it and you’ve been doing it for years, but if you haven’t, it’s a nightmare.

I don’t know what any of those acronyms (e.g. blortlib2.4) stand for.

“sudo apt update && sudo apt upgrade” is about as human-friendly as the Borg. Double ‘&’ signs, double double acronyms (sudo and apt), plus remembering what order any of it goes in, because there’s no rational reason to it?

By the second large paragraph, my eyes already glazed over. Too many instructions with too many variables / acronyms with too many decisions = your product will never, ever achieve mass adoption.

And they certainly know it, so it’s that way on purpose, to keep it exclusive to themselves.

If they wanted to, certainly they could streamline it and program it to make it easy enough for my Mom to do it.

As it is, I couldn’t do it without copying and pasting the instructions, and then going through them line by line.

And then saving the instructions, because I would need to repeat the process a hundred times before I could do it with my eyes closed.

That’s just nuts for a widely used operating system 😂

Now, if you want to take care of your Mom, there’s a few ways to deal with it. You could securely log into your mom’s computer over the internet and do it yourself…..or you can put the commands in a file and make it executable — e.g. “MomUp”

— which has someone making significant choices who doesn’t know what they are.

You could visit her more often and do it for her…..

Because I was flagged for that upgrade, I performed the upgrade using the pretty software upgrade that does warnings and comes with the distribution instead of doing it in stages. I went back and checked and doing it in stages wouldn’t have done any more.

I frequently note that Linux is the “Erector Set” of Operating Systems (or, if you prefer, LEGO). You can build anything to be as smooth and sophisticated as you like…..or, you can do things a piece at a time. Whatever floats your boat.

It is very common to use something like that in technical contexts — a lot of time, things are called “foo” and “bar”.

Back in the day I was actually coding, I frequently called the value I was dealing with “victim”, so I could see it amongst all the helper variables and procedure names. I once had a TA helpfully point out that this was unprofessional, to which I replied, “yeah, I know…..I am in a class…..”

Thankfully, and I say this respectfully, cthulhu is so enamored with the potential for “simplified administrative complexity” in Linux, that he diverts attention from the reality of the platform’s potential for “user self-administered simplicity”.

NONE of that XXXX is necessary – to be perfectly blunt.

In my opinion, having been in search thereof for years, Ubuntu itself, and a handful of other versions, have been “grandma-proof” since somewhere between 2005 and 2010.

The goal of a “grandma-proof” admin (typically a son or grandson) is to shield the user from such complexities. The user should never even know what “sudo” is. They should care about none of that. They should simply marvel that “this version of Windows is so much nicer than the Microsoft one.”

It is exactly what one sees when a scientific group – almost none of whom give a damn about the “computer stuff” – are on Linux or Unix. They just want it to work. IMO, Ubuntu offers that.

In fact, Ubuntu offers more, in that “pre-dementia Grandma” can very likely install it herself, on an old computer, from a CD or USB stick.

One of the best reasons for oldsters to be on Linux, is to lower the chances of malware-assisted fraud by foreigners [mostly INDIAN] who should be hung and their heads put on pikes [COUGH]. Those crooks rely on Windows, mostly, but even now are victimizing people on Mac.

Save Granny’s bacon! Get her on Ubuntu. For her, the only “sudo” should be the mRNA in the vaccines she doesn’t get.

Ubuntu, or any derivative thereof (e.g. Mint, Zorin, etc.) nudzhes you regularly about upgrades. If you just open that and say “yes”, they will be applied. That’s right out of the box.

It can, of course, be tweaked.

About the only thing that doesn’t work on first boot is the system firewall. It is generally managed by ufw “Uncomplicated Fire Wall”. One “sudo ufw enable” will have the computer use it for life. It can also be set with gufw. It looks like Zorin starts it on install, but it wasn’t started on install the last time I checked Ubuntu.

My Timex Sinclair with a 16k RAM expansion pack runs on Basic – those operation commands are eerily similar to the Mrs. commands & therefore easy to remember.

You have to endure a geek talking tech until you get to about 6:30 minutes. Then he confirms what I said – that SSD drives can fail without warning from causes that S.M.A.R.T. does not see coming.

Yep. I have a spinning rust external drive that I back up to on an ongoing basis. But I’ve heard that the newer SSDs last a lot longer these days.

It was explained as roughly this to me.

If one is only interested in saving the current version of a target drive, then backing up to SSD is fine, because if the backup drive fails, just grab a new image of the current target drive using a fresh SSD for the backup.

If one is interested in preserving the full history of the drive, then backing up to an actual hard disk is safer, because they last longer, give warning of problems, and are recoverable, meaning that full history will likely be saved, and can be copied to another backup disk in time.

There’s always a ton of professional laptops there, I think because big companies buy them in bulk for their employees, and replace them every year or two. Refubishing companies then buy them up, do their thing, and sell them cheap. And since they’re so cheap, even if I replace mine every three or four years, who cares?

Nice! I’ve been really impressed with their complete Help documents on the Zorin website and a big, friendly forum. I’ve always heard that the Linux forms weren’t very newbie friendly, but this one seems to be. I think Zorin is a really good distro for people coming from Windows. I think many Win users would feel right at home if they checked out this desktop and played around with it awhile. I’m going to have fun with it, whether I use it a lot or not.

Kalbo, actually the installation was actually pretty easy. The hardest part was just putting the downloaded installation on a bootable usb stick, then making my computer boot from it. But there are several free programs you can download that will make a usb stick bootable. I used Rufus. And changing the boot order on my computer just meant hitting F2 right after I turned it on and changing the BIOS. Then you can boot with the usb stick and simply follow the simple instructions to install the program.

I just had an epiphany, and it shook me.

All this talk about confrontation in the force. All this talk about discipline, about leadership, about correcting Soldiers and enforcing standards. And suddenly it hit me: we are chemically destroying the very ability to confront.

Look around. Testosterone, the literal hormone that fuels assertiveness, confrontation, risk-taking, leadership, is at record lows across the country, and yes, across the force. Since the 1990s, average male testosterone levels have dropped 20–30%.

Young men today have testosterone levels 150–200 points lower than their fathers and grandfathers. (Source: Journal of Clinical Endocrinology and Metabolism, Travison et al.) Obesity, endocrine-disrupting chemicals, chronic stress, sleep deprivation, junk food, and a sedentary lifestyle are wrecking the biological foundations of courage and confrontation.

And what have we done in the military during the same period? We stopped hard PT through COVID. We weakened physical fitness standards and are still struggling to get them under control.

We flooded the DFACs with junk food. We looked the other way as obesity rates climbed through the roof. We replaced confrontation with paperwork. We promoted compliance over correction. We buried the warrior spirit under administrative processes.

And now we’re surprised? We’re surprised that Soldiers don’t correct each other? We’re surprised that leaders shy away from confrontation? We’re surprised that standards have collapsed?

It’s not just fear. It’s not just DEI. It’s biology. You can’t build lions if you feed them like lambs.

Testosterone matters because it’s what fuels courage. Testosterone is what feeds the willingness to risk your own standing to correct someone who is wrong. Testosterone is what fuels the confrontation that holds units together. Testosterone gives you the fire to challenge yourself, to confront weakness, and to fight back against decay. When you crush it chemically, you don’t just get softer bodies. You get softer spirits.

This is why the cultural war inside the force cannot be separated from the health of the force. If you want warriors again, you must build them again. Feed them real food. Train them brutally. Make them sleep. Confront them early and often. Set standards so high that rising to meet them becomes not just a choice, but a chemical inevitability.

Because the soul of a warrior isn’t just an idea. It’s flesh, blood, and fire. And right now, we have almost smothered it. You can’t order confrontation from a dead spirit. You have to resurrect it. Fix the body. Fix the mind. And the spirit will rise.

I have a plan.

Since the problem is judges who obtained their position by every conceivable means other than merit, the solution is simple.

A Republican majority Congress passes a law requiring every sitting judge to pass a competency exam, which is made public (the exam and every judge’s answers), and if they pass, and begin to relapse in the future, they can be removed for cause if they go against their own positions and supporting legal principles that were established in the competency exam.

Make the exam appropriately difficult as it should be for anyone who sits in judgment over others. Base the questions on actual cases, the kind of questions the Problem People always get wrong in the same direction (Left).

But make the questions look easy, so when the Problem People get the answers wrong and fail, and then they whine and cry and get stompy feet about how unfair the questions are, the public can be shown the questions, and then the public will LAUGH at them for getting the answers wrong.

Humiliate them into silence.

The ones who come after the first few won’t be so fast to complain, because they don’t want to be the next contestant on Let’s Ridicule the Problem-People Judge.

The ones who are smart enough to get the answers right will have established a baseline of supporting all of the appropriate legal principles necessary to reach the correct conclusion.

So if they ever as soon as they begin to RELAPSE and fall back into their crooked ways, they can be challenged based on their competency exam answers, and removed for cause.

Exams are televised live. Not because anybody particularly wants to watch, but because the process should be open and transparent, and if anyone wants to watch, they should be able to.

The tests can be randomly generated from a large pool of potential questions, the same way other state exam tests are compiled (e.g., broker exam), so every test is unique, yet every test is calibrated to the same level of difficulty.

So the only way to cheat in that case is if you have ALL of the questions and study for ALL of them, which takes too much time and effort to do. Especially for a DEI hire, I mean, let’s get real… 😂

And even if they know the questions in advance, they still have to ‘prove their work’ by explaining their legal reasoning (these would be essay tests) and arrive at the correct conclusion.

That would be up to Congress, regarding how they want to structure the law. I would say one and done. If you are a sitting judge, and you have already been squatting on that bench for years, and you can’t pass the test, then you have no business on that bench.

They could go back to law school, get a real degree this time, and then possibly get nominated a second time, and if confirmed, then the DEI hire could potentially be re-appointed.

And then they would have to take the test again once they become a judge (again), and they wouldn’t pass it the second time anyway, because they never had what it takes to be a judge in the first place.

And nobody knows that better than the DEI hire, so they wouldn’t even bother to try, once they were discovered to be frauds in judge’s clothing in the first place.

Finally, I take up the Sword of the Spirit which is the holy word of God, I pray this powerful offensive weapon into my hand, and ask that your holy word would be fitting for every encounter I face. As the enemy gets close to me, please give me the insight, wisdom, and skill to wield the word of God to drive away the enemy, in my Lord Jesus name.

May the enemy and his team flee from me, upon hearing the word of God spoken by the power and direction of the Holy Spirit. Give me the sword of the spirit to cut through the wiles of the devil, so that I may discern the schemes of the enemy when he is near.

With all kinds of prayers, supplication, and intercession I pray to you my Lord God as the one who fights my battles. Here to say streets there in San Antonio get shut down for things as simple as birthday parties. Likely not unusual anywhere in the USA, to include Dallas where this apparently happened.

So the guy fires back with this tweet and it gets 30K likes and 497 comments 98% of them of a xenophobic nature with the end goal of packing them all up and sending them back to India.

Now there is some irony here as the Indian’s used business hygiene as a weapon against this LLC. Needless to say the 497 turned that against them in a big way given much of India is still economically in third world status and by American standards their business hygiene can be rather appalling.

I also may be over my skies here saying this originated in the MIC world. It likely did not, but given the 30K likes and tone of the comments it was likely seized upon by them which would be my opinion and if not it’s still an indicator of how hate is seeping into our cultural fabric. I’m sure we can all find hundreds of reasons why people from India should not be here, H1b visas might be a good place to start, but with no effort at all you should be able to find many more why there just fine as long as they are law abiding. Police launched a massive manhunt Tuesday for a violent sex offender and career criminal sought in the horrific Queens fire that killed the elderly parents of an FDNY paramedic.

Jamel McGriff, 42, an ex-con on probation with a string of career busts, has been identified as a suspect in the vicious deaths of 78-year-old Maureen Olton and her husband, Frank Thomas Olton, 76, who was found bound to a pole in the basement with multiple stab wounds after their Bellerose home was torched Monday, police and law enforcement sources said.

NYPD Commissioner Jessica Tisch said McGriff is “armed and dangerous.”

Tisch said the suspected killer entered the 254th Street home through a backdoor around 10:15 a.m. Monday – and was caught on surveillance footage leaving after terrorizing the elderly victims for nearly five hours.

According to ABC Eyewitness News, Frank Olton had been doused with a flammable liquid and set on fire, while both victims were stabbed multiple times.

What exactly was obvious? This is written and discussed often on the internet news shows where the views of both sides are given consideration. Are you saying there is only one side to the story? Make an effort to flip it around and find out what the other side is saying. If one doesn’t then one keeps walking in la la land wondering why they are back again.

Iran was under the impression they’re continued dialogue with the US about the Nuke stuff meant talks were still in progress until suddenly they were not.

I don’t know how anyone can blame the Israeli gov’t, so long as the Palestinians refuse to let the hostages go.

That is first, foremost and practically the only impediment to a ceasefire, and the only people who have control over making it happen are the Palestinians.

Well, I know he bought a house. And I know that if you run a PAC, you are allowed to draw a salary for doing so. I hope no one would expect that Scott, or anyone, would work for nothing.

So I can’t answer your question as to whether funds were “mis-used.” I suppose the PAC would need to be audited for that. Which I doubt any of the people spreading the rumor have done.

SD: “There’s a reason why the J6 Committee deleted the records of their activity, an angle missed by most. When you understand what they hid and why they did it, you then understand why current Speaker of The House Mike Johnson will not go near the subject.

The J6 Committee used interfaces with the NSA database and pre-existing portals with aligned DHS Social Media databases (including Twitter, see prior “Twitter Files”), as research and evidence gathering mechanisms for their investigations.

The J6 targets were identified through a collaboration between the legislative research group and the FBI. [That’s unlawful by the way – but that’s another matter]. The FBI contracted Palantir to identify the targets using facial recognition software and private sector databases.

Once identified, the targets were then searched in the NSA database for a fulsome context of identity. All subsequent electronic metadata of the targets was retrieved and utilized in prosecution; however, no one ever discovered this was the collaborative method. That has not come out yet.

Ultimately, the J6 Committee hiding and deleting their files and operational techniques was due to several issues. They really didn’t have a choice given the unknowns of an incoming republican majority.

First, the collaboration with the FBI is unconstitutional. Legislative officers are not law enforcement officers. There is a separation of powers issue.

Second, ultimately – and most consequentially – all of the participants did not want the American public aware of the mass surveillance techniques that were carried out as part of the ’round up.’

Wait to see what the next NSA compliance audit looks like. Remember, these reports are more than a year behind the activity they highlight.

This is where a complete mental reset is needed.

The modern application of the fifty-year-old concept around FISA as a constitutional mechanism to search the private papers (data) of American citizens, is a fraud, a complete ruse.

The Foreign Intelligence Surveillance Act, FISA, represents the method used by the intelligence apparatus of the FBI to conduct surveillance. It was purposefully designed, as a method to avoid the problems with 4th amendment protections. However, the modern application of the FISA justification has no lawful basis.

♦CONTEXT – Beginning in/around 2012, after the Dept of Justice National Security Division was created by President Barack Obama and Attorney General Eric Holder, the use of FISA warrants were extended to include electronic searches of captured information held within the National Security Agency (NSA). This was the database into which former NSA employee Edward Snowden was creating the search engine software.

The capturing of information was relatively new; technology was still being developed. Rapid scale-ups of archives and data processing was underway. Various iterations of the search tools and processes were being tested and deployed.

Prior to 2010/2012 we were mostly talking about emails, phone calls and text messages. However, as more and more technology was deployed, the interfaces expanded. Today, almost every electronic interface is captured/stored within either the NSA database, or a private sector database with connections to the NSA search portals.

Arguably, all of the underlying data captures were unconstitutional, and when the captures were originally discovered there was some intense conversations about fourth amendment protections and Americans privacy. To set aside the concerns and justify the existence of electronic search measures, the American government justified existence via the FISA court process, which extended to cover the new capabilities.

Currently, almost every American interfaces electronically with some system that captures their data. In the private sector that data is then assembled, attributed and used for consumer product micro-targeting, i.e., all data is commercially monetized.

Local and state governments also interface with the federal government database. As a consequence, all data eventually flows to the NSA capture points where searches of the total assembly are possible.

As noted in various explanations of government collaboration with social media, DHS has access to the various databases which house information inside the private sector. The lines between govt and private sector data captures are nonexistent as both public information and private information databases can be searched through the same network.

This is the baseline to understand the scope of data collection.

The important part to understand is all of the data collected is searchable. Then you move on to ‘how’ can the data be searched.

The ‘how’ is where FISA comes into the picture as the justifiable mechanism that permits the federal government to search the database.

The existence of the database is no longer argued. The govt has now moved beyond justifying the existence of the stored data, and now the only point of contention is ‘how’ and ‘when’ the government may exploit it.

This is where the DOJ-NSD, FBI, U.S. Intelligence Community, Congress and even the Judicial Branch claim the FISA laws protect the unlawful exploitation of the search capability. However, did you know there is not a single example of a FISA search application to the FISA Court that has ever passed Inspector General review.

Prior to President Trump’s authorization of the OIG in 2017, no one was ever permitted to review, check or audit the government submissions to the FISA Court. From the moment the DOJ National Security Division was created to permit the enhanced search review, not a single oversight mechanism was ever in place.

Factually, in the timeline of FISA use not a single oversight mechanism was ever in place. The entire process, and think of searching the database as a process, was/is based on the ‘honor system’. That explains why it was so easy to weaponize by Obama/Holder.

As soon as President Trump permitted the Office of Inspector General to start looking at filled out FISA applications, and justified FISA search documents created by users who were searching through the database, what they discovered was a non-existent accountability system.

After the DOJ Office of Inspector General (OIG), Michael Horowitz, presented his December 2019 findings of the FISA application used against U.S person Carter Page, the gross deficiencies and intentional fraud were so extensive the IG said he was going to review a sample of FISA applications to identify if the fraud and abuse was widespread.

The OIG began reviewing FISA applications from eight field offices (the proverbial “rank and file”). The OIG selected 29 FISA applications from those field offices over the period of October 2014 to September 2019.

Additionally, every field office and the DOJ-NSD generate internal “Accuracy Reviews”, or self-checks on FISA applications; so, the OIG inspected 42 of the accuracy review FISA files to determine if they were compliant.

The results were so bad the IG produced an interim memorandum to the DOJ and FBI [pdf link here]. Within the 17-page-memo the IG notified Attorney General Bill Barr and FBI Director Chris Wray that all of the claimed FISA processes, in every field office, are grossly deficient, and in most cases, there is zero compliance with FISA standards.

The IG memorandum was presented before the Inspector General even looked at the specifics of the non-compliance.

Below is the report/memorandum. Additionally, I am summarizing the stunning top-lines identified by the IG memo:

  • The IG reviewed 29 FISA applications, surveillance warrants, used against U.S. persons.
  • The 29 FISA applications were from eight different field offices.
  • The FISA applications were from Oct/2014 through Sept/2019.
  • All of the FISA applications reviewed were approved by the FISA court.

The ‘Woods File’ is the mandatory FBI evidence file that contains the documentary proof to verify all statements against U.S. persons that are contained in the FISA application. Remember, this is a secret court, the FISA applications result in secret Title-1 surveillance and wiretaps against U.S. persons outside the fourth amendment.

♦ Within the 29 FISA applications reviewed, four were completely missing the Woods File. Meaning there was zero supportive evidence for any of the FBI claims against U.S. persons underpinning the FISA application. [ie. The FBI just made stuff up]

♦ Of the remaining 25 FISA applications, 100% of them, all of them, were materially deficient on the woods file requirement; and the average number of deficiencies per file was 20. Meaning an average of twenty direct statements against the target, supporting the purpose of the FISA application, sworn by the FBI affiant, were unsubstantiated. [The low was 5, the high was 63, the average per file was 20]

♦ Half of the FISA applications reviewed used Confidential Human Sources (CHS’s). The memo outlines that “many” of applications containing CHS claims had no supportive documentation attesting to the dependability of the CHS.

♦ Two of the 25 FISA applications reviewed had renewals; meaning the FISA applications were renewed to extended surveillance, wiretaps, etc. beyond the initial 90-days.  None of the renewals had any re-verification. Both FISAs that used renewals were not compliant.

Keep in mind, all of these applications/justifications to engage title-1 surveillance against suspects, were approved by the FISA court. How is this possible, unless the FISA Court is intentionally just a false front for a nonexistent process.

That’s my position now. There is no FISA process in place at all. It’s as if there’s a traffic light at an intersection, but the power is turned off. What good is the traffic light, other than to say there’s a traffic light at this intersection.

But wait… it gets worse.

The DOJ and FBI have an internal self-check mechanism. The DOJ National Security Division (DOJ-NSD) chief counsel, and the chief counsel for every FBI field office are required to conduct an “Accuracy Review” of selected FISA applications.

One review per FBI field office (25 to 30 field offices), which are also sent to DOJ-NSD (main justice) for general counsel inspection.

Keep in mind, these “accuracy reviews” are known in advance, so the FBI has all the time in the world to select the best FISA file for review.

Additionally, I surmise the OIG wanted to inspect the “accuracy review” FISA’s because they would show the best light on the overall system itself. The OIG was looking for the best, most compliant, product to report on.

However, when the OIG inspected 42 of these Accuracy Reviews, the IG identified that only three of them had accurately assembled documents (Woods File) supporting the application. The error rate within the files self-checked was over 93%.

So the best FBI files are selected to undergo the FBI and DOJ-NSD accuracy review. The accuracy review takes place by FBI legal counsel and DOJ-NSD legal counsel. However, the IG finds that only three FBI applications in the accuracy reviews were compliant.

The error rate in the files undertaken by the internal accuracy review was over 93% (3 compliant out of 42 reviewed). These were the FISA submissions with the greatest possibility of being accurate.

This is the baseline to understand what comes next.

Summary: The justification of FISA or FISA (702) as a mechanism to protect the American people from illegal searches of the NSA database IS A FRAUD. The searching of the NSA database not only continues but has factually expanded through today. There are no established limits on search use, only false claims that are fed to the public for popular consumption.

The DOJ and FBI are aware of this. The OIG is aware of this. The Intelligence Community is aware of this. The NSA is aware of this. The FISA Court is aware of this. The Supreme Court, which oversees the FISA Court, is aware of this. The Legislative Branch is aware of this.

We have the evidence and receipts.

Texas governor Greg Abbott has announced a ban on Sharia Law in the state after an imam launched a campaign to pressure Muslim-owned stores to stop selling pork, alcohol and lottery tickets.

Imam F. Qasim ibn Ali Khan of Masjid At-Tawhid was seen in a viral video confronting a store employee and accusing the business of selling ‘haram’ products forbidden under Islamic law. 

As a response, Abbott said on Tuesday: ‘I signed laws that BAN Sharia Law and Sharia Compounds in Texas. No business and no individual should fear fools like this.’

The governor also addressed the imam, saying: ‘If this person, or ANYONE, attempts to impose Sharia compliance, report it to local law enforcement or the Texas Dept. of Public Safety.’

In a statement, Abbott’s office added: ‘In Texas, we believe in equal rights under the law for all men, women, & children. Any legal system that flouts human rights is BANNED in the state of Texas.’
