After doing a couple of these, I think we DO get more out of a hearing, if we do the testimony, type out a min-summary of Congressman’s comment, and then ADD all the commenters here, for a total view, at the time, IN CONTEXT.

Retired paralegal here. I’ve worked on discovery plans in my past life. That is where you decide what evidence is needed, where it is likely to be, and what is the best method of getting it. Written questions, demands to admit certain facts, depositions, subpoenas for documents & records, etc. How many sets of written queries and what subjects in each set, how many depositions and who gets deposed, and most important IMO in what order are these tools rolled out.
All this and more is part of preparation for trial. It’s all very confidential. A lot of it is able to be figured out by the adversaries but secrecy is paramount.
As it gets rolled out and triggers are pulled, it is too late for the adversaries to do anything but react. Rarely is a counter-offensive possible. Of course the adversaries are doing the same thing on their side so there are two parallel ops going.
It has dawned on me that this is what Barr and Team Trump (however many that might be) are doing. The rollout is now being presented in public and it is a glorious rollout. DJT’s rant on treason while walking to Marine One is the equivalent of a prosecutor”s opening statement in a felony trial. The only thing missing is …

How much is shared by opposing counsels?
Multiple attorneys on the same side often have Joint Defense Agreements. These specify what areas will be shared and how much will be shared. Most have a list of specific items which remain confidential to the client of each attorney.
Each client can propound discovery but if it would turn the case into a paper avalanche, there will usually be an initial set of discovery which is for all defendants and then later on individual discovery actions can be done. Fed courts always have discovery conferences where conflicts are worked out (it is fun to watch judges in their shirtsleeves like Jordan while bossing around attorneys who are worried of getting on the judge’s bad side).
The main thing that isn’t shared is when a client wants to settle and go home. Never disclosed until the deal is done.
