Dear Mr. President:
Members of the Association of American Physicians and Surgeons (AAPS), representing thousands of physicians in all specialties in all states, would like to express our gratitude for your leadership at this time of crisis. We are thankful for your calm, rational approach and for your recognition of the need to control our borders, support private enterprise, restore our capability to manufacture essential items such as drugs and medical equipment, and relieve medical practice and the economy as a whole from the burden of counterproductive taxation and regulation.
Faced with a novel virus that could overwhelm our medical system, we need rapid deployment of testing, adequate supplies of protective equipment, a surge capacity for hospital beds and medical manpower, and better treatment options.
For testing, South Korea is a hundred thousand tests ahead of us. Why is this, despite the immense capability that we have in industry and university laboratories? The entrenched federal bureaucracy in the FDA and CDC blocked these efforts until a window of opportunity had closed.
The federal government has a stranglehold on laboratory medicine because of the Clinical Laboratory Improvement Act (CLIA). Deviation from complex regulations could destroy a laboratory. SARS-CoV-2 testing is complex and fraught with pitfalls. We need independent efforts, not a government-imposed monopoly. In addition to testing for the virus, which has many false positives and false negatives, we need tests for acute (IgM) and convalescent (IgG) antibodies, so far not part of the approved regimen.
Our capacity to manufacture antibiotics, vitamin C, protective gear, and most other drugs was outsourced overseas decades ago. Your Administration needs to investigate the reasons for this, including the single-source contracts that benefit Group Purchasing Organizations (GPOs) and Pharmacy Benefits Managers (PBMs). These are enabled by a safe harbor in the Anti-kickback Statute and the failure of HHS to enforce the safeguards. (This is also a huge factor in high prices.)
The culpability of the FDA must not be overlooked. FDA has the power to shut down U.S. production of a pharmaceutical because of noncompliance issues that have no effect on safety or quality, such as exceeding a production quota or a paperwork oversight. Yet the FDA has no meaningful oversight of the production of the 90 percent of our medications that are made in China and other foreign nations. Nor has it responded to national security concerns about drug supply lines.
The FDA has a crippling effect on innovation, with $1 to $2 billion worth of requirements to bring a new drug to market. This still does not guarantee safety, as shown by the number of drugs that have to be withdrawn. Worse, the FDA is increasingly trying to expand its authority over the practice of medicine as in the “off-label” use of approved medications. Medical practice would be crippled if physicians had to wait years for the approval of each and every use of long-established drugs—or forever if no one saw the benefit in investing billions in the approval process.
We thank you for helping to make the long-established anti-malarial drugs chloroquine and hydroxychloroquine available for treating COVID-19. In our opinion, a “compassionate-use exception” is not needed because these drugs are already approved for another use. It would be needed for a not-yet-approved drug such as resdemivir.
The FDA wants to address this crisis with an FDA-approved vaccine, which takes more than a year to develop and test (and may not even prove to be safe and effective), not by inexpensive generic medication available now without control by the FDA.
Americans need the right to try. This should apply to all, not just to terminal cancer patients. It should certainly include safe interventions such as intravenous vitamin C, which the FDA is trying to ban. Note that 50 tons of vitamin C was shipped to Wuhan recently, and efficacy studies are underway there.
We appreciate your effort to ameliorate the shortage of medical personnel by allowing payment for telemedicine consultations, and your previous efforts to reduce the Medicare documentation burdens. Practitioners estimate that their productivity is decreased by at least 20 percent by electronic medical records, coding requirements, MIPS, and so on. Why should physicians, like other professionals such as lawyers, not set their own fees without being tied to thousands of codes invented by the AMA and the WHO? Why couldn’t doctors get paid for treating COVID-19 without the AMA inventing a code for it? Why should insurers be dictating what care patients may receive, and what they may pay? Insurers should be transparent about what and how much they will reimburse, without interference in private arrangements. Likewise, government should not be dictating the terms of consensual arrangements.
A surge response is hindered by government licensure requirements. In federal facilities such as the Veterans Administration and correctional facilities, physicians may work if licensed by any state. In a national emergency, one state license should be sufficient for a physician to practice either in person or by telemedicine. A medical license might be honored in all states just as a driver’s license is.
Please also consider how medical school graduates who are unable to find a residency program match (approaching 10,000 grads per year) can be put to work helping patients during this time of increased need for medical care. These physicians often have twice the amount of training as nurse practitioners or physician assistants but are impeded from helping patients in clinical care settings.
We applaud efforts at all government levels to allow medical staff to work without time-devouring, pointless regulatory shackles. After a temporary reprieve, we hope that you will consider permanent relief.
We appreciate your understanding of the severe harm caused by the Chinese government’s lack of transparency in the early days. Please do not allow the U.S. to similarly constrain the flow of information from all sources. There are many unknowns. We need input from all who have experiences or ideas. We will not be able to sort out the errors from the facts until much more is known. Censorship should be anathema in these United States!
Most importantly, we need the right to try, and the right to communicate. While we need to minimize casualties from COVID-19, we must also survive as a constitutional Republic. We must not overlook old potential allies like the one George Washington used to protect his troops, the bark that contained quinine, of which chloroquine and hydroxychloroquine are analogs. Americans were protected against the malaria epidemic; the British were not. This unappreciated ally probably turned the tide at Yorktown.

You guys have been solid contributors on the COVID threads, and FLEP keeps us all upbeat. Congratulations to all. We’re weeks, sometimes months, ahead of the MSM….. and they’ve become embarrassing.
This Wednesday, in a Presidential Presser, a reporter asked the President of the United States, “How many deaths are acceptable?” What kind of an idiotic question is that? Don, Jr. had some thoughts on the subject.

As Flep pointed out today in the Good News RoundUp, the President’s pressers are getting high ratings. It makes sense. We’re all concerned, anxious, and want more information from our leaders. Well, an average presser’s ratings equal a season finale of The Bachelor, and sometimes, the President’s presser’s equal Monday Night Football ratings. Consequently, the President’s approval ratings are rising because the President is speaking directly to Americans, without a media filter. The media can’t have it. They want to stop covering the President’s pressers. Can you imagine? It’s true. Here is CNN:

This is from Associated Press, which feeds every newspaper in the country. The President was concerned about Americans being depressed, not working, no money, and the stress it would bring to average business owners and families. AP decided to “fact check” and argue this point…… shamefully.
The New York Times had to change headlines on articles two days this week, because the headlines criticized Dems too much and didn’t criticize Trump….. enough. What does that say about the NYTimes credibility as a “paper of record”. It’s disgusting. The Washington Post floated an article which claimed Doctors were considering DNR orders for the elderly. A brief check proved it wasn’t true. We can all imagine how such an article would scare the population.
Then, we have the problem of media……. in general. They’re like hyenas. It’s not productive. Lead, follow, or get out of the way. We don’t have time for this kind of childish behavior.

A typical pundit from MSNBC, https://twitter.com/chrislhayes, has a twitter thread which is dangerous. Everything is dire. Nurses and docs collapsing, hospitals on the brink, no equipment, people scared, and everything…….. is the fault of the Trump Administration. Yet, according to Dr. Birx in the presser Thursday, there are still ICU beds and ventilators available in NYC. That’s information important to the citizens of NYC. And according to Governor Cuomo’s presser today, every hospital in NYC has enough protective equipment. Contrary to the media articles. Why is the media lying to the people?
The answer is easy = Ratings, clicks, and more money………. by scaring people half to death with bad and incomplete information. No wonder the left is so jumpy, nervous, twitchy, and desperate. Time for the MSM to Go Their Own Way – Loving you, isn’t the right thing to do…… We’re done.

Q Treepers, by nature, are curious people. We have members with broad experience in various disciplines within our group, and yet, we’re old/wise enough to defer to others in their specialty. Good thing we’re all blessed with an inordinate amount of common sense. We’re also, normally, about 4-6 weeks ahead of the MSM……. Today, we’re looking out on the horizon and what do we see as a potential problem in the next month or so? You may see beautiful mountains and rivers, the scenery of West Virginia.
Yes, we’re fortunate at Q Tree to have those members who can help us with technical medical info. For me, I’m good at counting things, medicine is not my wheelhouse….. but I sure can count money and square footage. I’m approaching the plateau of the COVID-19 Learning Curve when it comes to a virus/therapeutics/vaccines/bats and bioweapons, but when a China virus solution which costs trillions of taxpayer dollars, the hair stands up on the back of my neck and my eyebrows start to twitch. I can’t help it. We’re gonna need more information.
For the time being, let us set-aside the 2+4 trillion for the Senate bill, and let’s focus on the virus itself. The USA and world economies will not get back to normal until we have SOME kind of treatment. We need to alleviate the fear, remove a few of the unknown variables. Hydroxychloroquine + ZPack seems to be the easiest treatment for COVID-19. The drug cocktail is receiving a LOT of attention, both good and bad, depending on your politics. We know Bayer donated 3 million doses, Teva donated 6 million, and Novartis donated 130 million, but the USA will need more, and the world would need billions of doses. Okay, where are the meds coming from and who is paying for them? We need to know who we are paying, right? We certainly don’t want to send USD to China!
On my Q Tree horizon, I see 1,000,000 sq.ft. factory under roof, 23 acres, in Morgantown, WV. It’s been the home of Mylan Pharmaceuticals since 1965. Yet, we detect a strange smell, the stench of a dead fish….. or a big fat rat, maybe it’s a swamp rat. We need more information. Let’s dig deeper. Shall we?
Mylan Pharma/Labs is enormous and linked to WVU, a large university medical system in Morgantown, WV.
Mylan is/was #396 on the Fortune 500 and largely makes generics. TODAY, Mylan Labs announced, reported by FOX BUSINESS, they released the proprietary licensing on the generic for Hydroxychloroquine so any pharma can gear up and make the drugs during a National Emergency. Do you suppose the USA is expecting a Malaria outbreak? Gee whiz, wonder if it has something to do with that treatment for CCP Virus the President has been talking about….. you know the one……. where the media assumes Trump is crazy/dangerous/may kill people? Why would Mylan make such an announcement?

Of course, Mylan Pharma announced March 19, 2020: (That’s a week ago. Did you see MSNBC reporters interviewing any execs at Mylan?)
….. restarted production of its hydroxychloroquine sulfate tablets at its West Virginia manufacturing facility as a potential treatment for COVID-19, the disease caused by the new coronavirus. The company plans to have product available by mid-April and thinks it can ramp up to 50 million tablets, which could treat more than 1.5 million people. (Imagine our surprise, but this is good news, right?)
Chloroquine and hydroxychloroquine, a less toxic metabolite of chloroquine, are antiviral medications that are approved to treat malaria. Because it’s less toxic and has anti-inflammatory properties, hydroxychloroquine is also approved to treat a pair of auto-immune disorders, lupus erythematosus and rheumatoid arthritis.
An article published in the journal Cell Research in February showed that chloroquine inhibited the 2019-nCoV coronavirus as well as Gilead Sciences‘ (NASDAQ:GILD) remdesivir in an experiment testing how well the virus infects cells grown in a laboratory. Gilead is running a late-stage clinical trial of remdesivir as a COVID-19 treatment, but since it hasn’t been approved for any diseases, remdesivir isn’t as widely available as chloroquine and hydroxychloroquine. (Hmmmm, so…… Mylan Labs knows enough about the “Trump treatment” to go into full production, asap? But the media tells us it’s a dumb idea, right?)

Heather went to a local high school and WVU for a degree in Poli Sci and International Relations. She started as a clerk, typing labels at Mylan and rose to CEO…. her daddy helped her get a job in 1992. Heather lied about having an MBA, falsifying her resume. Mini-scandal in 2007 – WVU gave her the degree although she only finished 28/46 hrs required. But in 2008, professors on the panel who voted to grant Heather an MBA, had to retire under vote of no-confidence, and WVU rescinded her degree. Heather never lost her job. In the world of big pharma, sometimes it’s better to understand politics – rather than science and medicine. And Heather is reallllllllly good when it comes to understanding politics. And then, Mylan Pharma left the USA and no longer pays taxes here. They left for the Netherlands.

With a Maximum Corp Tax rate of 21% after Trump’s Tax cuts, one would think Heather would bring back Mylan to the USA, right? Has she? ………… not yet. Heather had other problems. In 2016, Mylan was sued by 40 states Attys General for price fixing. The price-fixing controversy was settled just in time for the EPIPEN disaster to come to the forefront. Heather didn’t resign under this PR disaster either.
Mylan acquired the 50yr old right to Epipen in years prior, but the product only had sales of $200 million. Heather came up with an idea. Read what Heather did to boost her stock price.

Wait, let’s read that part again.…………. You mean….. We didn’t need defibrillators in schools and community centers until Medtronic lobbyists created the legislation to mandate it? Yep, that’s right.
And Heather Bresch followed the same model as Medtronic, hired the same lobbyists, and made Epi-Pens MANDATORY, then they increased the price of the Epipens from $100/two pack to $600/two-pack. Yep, that’s right. And Mylan pays taxes on the profits in Netherlands……. not the USA.
That’s what happened. Throughout the whole Epi-Pen controversy, parents screaming about the increase in price of Epi-Pens because they had to buy them to send their kids back to school, Heather never lost her job. She did agree to make a “generic” which was only $300/two-pack….. which is still much higher than original price before Mylan acquired the rights to sell the product. The controversy flooded the news:
Heather has done very well for herself. She’s been able to lobby the FDA to work on behalf of Mylan. She schmoozed both the Bush and Obama Administrations. She shipped an American company to the Netherlands (but she felt badly about it…..) so the USA no longer receives tax dollars……. the taxpayer just pays for the meds. And Heather? She kept her job despite lying on a resume and ripping off American parents. She’s profited handsomely. Proxy filings show that from 2007 to 2015, Bresch’s compensation rose from $2,453,456 to $18,931,068, a 671% increase in pay.[34][37]
As CEO, Heather makes a lot more than Daddy does as a Senator. I’m guessing Christmas dinner is held at Heather’s house. Whaddaya think? In the swamp of Dems taking care of their kids, Heather got a much better deal than Hunter Biden. Joe Manchin’s influence as Governor and a US Senator helped his daughter handsomely……….. or was it Heather’s husband?
