OVERVIEW

In December 2020 our cyber election team was invited by Mrs. Courtney Bailey-Kanelos, the Registrar of Voters in Sacramento County, California to review Sacramento’s election system, and to audit the 2020 election results.  The cyber election team was offered a $1.00 contract by the Registrar of Voters to perform the work (see Exhibits).  The cyber election team accepted, and placed a technician on a plane to Sacramento within 24 hours.

ENVIRONMENT

Unfortunately, if one has spent any time in Washington, DC, one understands that the town is filled with people who have extremely sharp elbows, and frequently put their own agendas above the interests of the American people.  In this instance, a bad actor got word that a technician was on a plane headed to Sacramento, and proceeded to blow-up phones in Sacramento.  Before the cyber election team’s tech landed in Sacramento, the audit effort had been squashed, as others in the County were now involved and the brakes put on the planned contract.  Obviously, this was a great disappointment.

LIMITED CASE STUDY

The cyber election team’s technician did, however, receive a tour of the election facility by Mrs. Bailey-Kanelos, who was and continues to be extremely gracious in all dealings.  The cyber election team’s technician was escorted to every part of the building by Mrs. Bailey-Kanelos and allowed to take photographs of anything he wished.

In this brief document, we will post some of these photographs, and explain their significance, as they demonstrate how an election official, with the best of intentions, can expose this complicated election system to bad actors and potential manipulation…

The Democratic Party has an international arm called the National Democratic Institute (NDI). It’s funded by $181M/year in US tax dollars. Its board includes Stacey Abrams, Donna Brazile, and Tom Daschle.

But in regards to today’s SAVE America Act debate… did you know that the NDI has taught and supervised election processes all over the world?

For 40 years, NDI has told every developing country on earth that voter ID is essential for election integrity. They’ve recommended biometric systems… yes, that’s right, NDI recommended biometric systems, which goes way beyond SAVE America Act! They praised fingerprint verification. Tracked ID card issuance rates.

Meanwhile, Democrats call the SAVE Act “Jim Crow 2.0.”

Same party. Same people. Opposite positions.

NDI’s own 2001 guide emphasizes the importance of only citizens voting. It further says voter ID cards “introduce an additional safeguard into the system” and describes photo ID and fingerprints as standard election infrastructure.


In one of their PDFs, the complaint in Nicaragua wasn’t that voter ID existed. It was that the government wasn’t issuing ID cards FAST ENOUGH. They even called the issuance of temporary IDs as ignoring “the far more fundamental problem.”

In Morocco, NDI praised the switch to requiring just ONE photo ID at the polls, calling it “a positive development.” The SAVE Act requires one photo ID. Democrats call that Jim Crow.

In Bangladesh, NDI praised voter photo ID cards as giving “a sense of empowerment and belonging to the disadvantaged and marginalized people of the country, particularly women.”

I don’t know the legalities, but if the pattern holds, a judge will strike down the EO and they will try to stop it, and then delay its implementation until it’s too late for the elections this year. If the Senate doesn’t pass the SAVE America Act, people will be furious with them but the bad actors will get reelected if the cheating is not stopped.

This was a fairly wild discussion where David Friedberg (from the All-In Podcast) interviews someone named Bryan Johnson, who I was not familiar with (with whom I was not familiar, but that sounds so… English Literaturistic 😁).

Apparently Bryan Johnson is some kind of health and rejuvenation expert, and the most recent experiments he has performed on himself, apparently in very clinically controlled settings, have invovled psychedelic drugs, to study their impact on neuroplasticity and rejuvenation of the human brain.

I knew a guy once who went to South America to a shaman for an ayahuasca trip that he thought would “cure” his depression and anxiety. He came back weird. COMMENTARY FOR 1 JOHN 3:20

The apostle admires the love of God in making believers his children. (1,2) The purifying influence of the hope of seeing Christ, and the danger of pretending to this, and living in sin. (3-10) Love to the brethren is the character of real Christians. (11-15) That love described by its actings. (16-21) The advantage of faith, love, and obedience. (22-24)

16-21 Here is the condescension, the miracle, the mystery of Divine love, that God would redeem the church with his own blood. Surely we should love those whom God has loved, and so loved. The Holy Spirit, grieved at selfishness, will leave the selfish heart without comfort, and full of darkness and terror. By what can it be known that a man has a true sense of the love of Christ for perishing sinners, or that the love of God has been planted in his heart by the Holy Spirit, if the love of the world and its good overcomes the feelings of compassion to a perishing brother? Every instance of this selfishness must weaken the evidences of a man’s conversion; when habitual and allowed, it must decide against him. If conscience condemn us in known sin, or the neglect of known duty, God does so too. Let conscience therefore be well-informed, be heard, and diligently attended to.

WE ARE FIGHTING A SPIRITUAL WAR OF GOOD VERSUS EVIL

PRAYING ON THE ARMOR OF GOD

Father God, I now follow your command to put on the full armor of God, because my battle is not against flesh and blood but against rulers, authorities, the powers of this dark world and against spiritual forces of evil in the unseen world.

I first pray on the Belt of Truth that it may be buckled around my waist, may I be centered and encircled by your truth dear Lord. Hem me inside all that is true and right, and may I be protected and held up by the truth of your living word, in my Lord Jesus name.

I pray on the Breastplate of righteousness, please protect my vital organs and my inner man, cover my integrity, my spirit, and my soul. Guard my heart for it is the wellspring of life, please strengthen and guard the most vulnerable places in my life with that which is right, good, and noble that I might not receive a fatal blow from the enemy, in my Lord Jesus name.

I pray on the Gospel Shoes of Peace. I choose to stand in the shoes of your good news, and on the firm foundation of my Lord and Savior Jesus Christ, the solid eternal rock. All other ground is sinking sand, I pray that I will not slip or fall, but that my feet would be firmly fitted on your lordship, my Lord Jesus. I choose to stand on you, so that the peace of God, which transcends all understanding will guard my heart and mind in Christ Jesus, the eternal Rock of Ages. I receive your holy peace now my Lord, from the sole of my feet to the crown of my head, in my Lord Jesus name.

I pray the Shield of Faith into my hand now. As I take up the shield of faith, I ask that you might extinguish every dart and arrow that is launched from the enemy to take me down spiritually, physically, mentally, emotionally, and every attempt of the enemy to destroy my joy. I ask that my faith in you would make it flame out. Extinguish every flaming arrow that would come against me, my life, my family, my home, or my ministry. May my faith always be out in front of me like a shield. Give me the courage to “faith my fears” by choosing to walk by faith and not by sight, in my Lord Jesus name.

I pray on the Helmet of Salvation, that you might protect my mind from the thoughts that can lead me astray. I choose to take every thought captive, and arrest all intentioned ideas and motives that would harm others, or distract me from your holy will for me. I submit every captured thought to the Lordship of my Lord Jesus Christ, and ask that you would imprison those thoughts that are not of you my Lord. Transform my mind and renew my thinking that I may think God thoughts, and have a sober mind that is focused on your glory. Please protect me from being double minded that I may allow my mind, I reject to live an earthly life, because I choose to live a holy one, governed by you My Lord Jesus, the prince of peace, please have my mind to be saturated with the holy mind of Christ, in my Lord Jesus name.

Finally, I take up the Sword of the Spirit which is the holy word of God, I pray this powerful offensive weapon into my hand, and ask that your holy word would be fitting for every encounter I face. As the enemy gets close to me, please give me the insight, wisdom, and skill to wield the word of God to drive away the enemy, in my Lord Jesus name.

May the enemy and his team flee from me, upon hearing the word of God spoken by the power and direction of the Holy Spirit. Give me the sword of the spirit to cut through the wiles of the devil, so that I may discern the schemes of the enemy when he is near.

With all kinds of prayers, supplication, and intercession I pray to you my Lord God as the one who fights my battles. Now that I’m in your holy powerful armor, I walk away covered and ready to face my day as you go before me, and please protect me in the midst of the spiritual warfare in this unseen world, in my Lord Jesus name.

Thank you my Lord, for the spiritual weapons of armor and prayer that you have given me. It is written no weapon formed against me shall prosper, and you will refute every tongue that accuses me. 

Thank you Father God, my Lord Jesus and the Holy Spirit, that I am more than a conqueror in my Lord Jesus. I pray all of this in the mighty name of my Lord God and Savior Jesus Christ, Amen.

Back in the day, I would live off what I used to every time I got a raise, and put the raise into savings. When I got a subsequent raise, I’d put that into savings and start living the lifestyle of my previous raise.

My wife’s dream hobby is flitting from one thrift store to another, scarfing up some really nice stuff. When people die, most of their clothing ends up in thrift stores.

The most fertile ones are in [or close by] upscale neighborhoods.

Some of the best thrift stores are the ones that support “causes” that rich people like. There’s one near me that supports a women’s shelter. I find some really nice stuff in there!

If you want to dress nice on a budget, thrift stores are your friend. I find things with the tags still on them all the time! I think well off people just donate stuff after they buy it, take it home, and realize they don’t really like it. Too much trouble to return it, I guess.

I have found really high end stuff, too. I have two purses that sell in the $600 to $800 range that I picked up for less than $10.

New furniture is, for the most part, crap. One time, I bought a very expensive couch (like $4000) at a very deep discount. The fabric had been discontinued, but I liked it. The couch lasted about ten years. My grandma’s old couch was in better shape at 30 years old than that thing was at ten!

I like old furniture have a desk from late seventeen hundred and a Chinese cabinet from china before the revolution and other antiques.
Did buy lace curtains for three rooms for $10 at a church yard sale. I used to buy at yard sale new linen napkins napkins from Ireland and hand made lace. Linen pillow cases with knitted lace made by nuns. I have a trunk full love old things they are real hand made.
I also bought at yard sale old broken jewelry and made new from it. Our local museum auctioned some off and other jewelry they bought from me.
Clothe I make or buy new. I have my own style . I am very European that way. I do not care what other people wear . I focus what I like. I do everything that way. Actually it is very freeing  😂

I found a fascinating thing at the thrift store just today!

I saw this beautiful purse, and picked it up. It is oxblood colored very nice leather with a really nice lining. It is in lovely condition with very little wear.

I looked at the label and saw that it was made in West Germany! So of course, it’s at least pre-1989.

I bought it ($4, big spender I am) brought it home and looked it up. It turns out it was a very expensive “luxury brand.” So I scored a good one today.

The price of cigarettes is mostly taxes. I switched to little cigars, filtered, 20 in a pack that looks just like a cigarette flip-top box, and costs 90 cents.

Bonus – it’s pure tobacco; none of those funky chemicals that they put in cigarettes to keep them burning.

The particular brand that I buy is available at only one Indian smoke shop. Other brands are more available but generally only at Indian smoke shops. All of them are made on reservations and not supplied to ‘white man stores’.  😎

Meant to post this, yesterday, on TBs budgeting post.

Slow Guy’s budgeting journey.

~1981. E-5. DW plus three. Could barely make it, payday to payday. Scrape together coins to buy bread, milk before the next payday. Lots of hotdog fried rice, spaghetti o’s, Ramen noodles…

Kids clothes and toys, yard sales. Shoes and underwear, K-Mart or Walmart, usually when school started. Or they truly out grew their one pair of shoes.

Had never budgeted. The two of us arrived at, Needs Vs Wants. Maybe I read an article somewhere. OR DW, Common Sense, to see the obvious.

Helped as we muddled forward.

Then heard about, pay yourself first. Meager investment, every payday. Savings, savings bonds…anything…but Start Saving. It Add Up. Compounds…

  • Made sense. Took another year or so, to make the leap, paying ourselves.

Next annual raise, the couple percent President authorized, 50% went to paying, ourselves.

  • Adopted this practice for the next 40 years.
  • Every raise, (promotion, longevity, or annual) 50% went to “paying our selves”. Remaining Needs, and increasingly so, a few wants.
  • As a civilian, saving 50% extended to rare “bonus”.
  • SAVE for our future was our financial baseline.

1986, while on seven month cruise onboard Enterprise. DW paid off credit cards. Lived hard core, Needs Vs Wants.

  • Since before July 1986, when i returned from cruise, We Have Never Carried A Credit Card Balance Forward. To this day.
  • Adopted, if we cannot pay off the CC, when the bill arrives, Delay the purchase or Cancel the purchase.

It was late 80’s before we could, entertain, wants, most paydays.

A little personal discipline AND NOT buying every new gadget, cool vacations, whiz bang vehicles, CAN yield financial security.

As broke as we were ~47 years ago, we never felt poor. We were happy. Safe place to live. Three simple meals. Daily family walks, parks… Simple Life. Great Memories.

We do occasionally get a new CC from NFCU or USAA. Usual financial businesses.

  • Usually something similar to, charge $1,000 in two months and get $200 credit.
  • CC used for what we’d normally buy.
  • Get the credit. Transfer credit to checking. Cancel CC.

And the Fraudulent Reserve scheme wrecked all that, for most people. Keep in mind that you had what an old friend of mine called General Motors when he worked there – Generous Mother. Every two [or four] weeks, money came in, rain or shine. That takes a lot of the burden off.

I spent my adult life working commission as an auto mechanic [until I switched to paralegal; long story for another time]. No completed repair job; no pay.

When we started we had not much and we had a simple life good budgeting and creativity. Kids got one toy for Christmas what they really wanted had to be out of wood no batteries. Then we bought educational items and books.
Last week my youngest called thanking me for his happy childhood and that he did not miss a thing. He remember each toy each trip to the park , museum , zoo, botanical garden and free concerts and baseball games. My husband got several free ticket every year for St Louis cardinal games.
He complained that his friend who had more than he growing up complain what their parents did not do for them. He was fed up with them.
His call warmed my heart I always wounder if I did enough. Being there when they came home from school listening when they had a bad day was most important then things.

I am NOT trying to start an argument, and I won’t engage in one. But the discussion we’ve had here before about “unalienable” rights has bothered me for a long time. And I just ran across it again, in a different context. I found new information.

Yesterday, the SCOTUS ruled against a law forbidding conversion therapy. In his writing for the majority, Gorsuch wrote:

““But the First Amendment stands as a shield against any effort to enforce orthodoxy in thought or speech in this country. It reflects instead a judgment that every American possesses an inalienable right to think and speak freely, and a faith in the free marketplace of ideas as the best means for discovering the truth,” the majority court opinion stated.”

It surprised me that he used the word “inalienable” rather than “unalienable.” But he really did, I went and checked the opinion. He used inalienable throughout:

I then found this archived article from 2009 I have read before about the difference between “unalienable” and “inalienable,” and why it is important. A guy asked a radio host this question:

“I do have a question. You pronounce “unalienable” as “un-a-LEEN-able”…but the only pronunciation I’m aware of is “uhn-eyl-yuh-nuh-buh l” (http://www.dictionary.com), as in alien, alienate, etc., with the accent always on the “a”. It could just be that it jars my musician’s ears (I was a professional violinist before becoming a software architect), but is there some specific reason you pronounce it that way? In any event, this is a minor quibble about an otherwise-invaluable discussion. A discussion, I fear, that our current Administration will move to suppress soon…I hope to God I’m wrong. Keep informing us.”

The guy gives a VERY detailed answer about the difference between “inalienable” and “unalienable.” Within the explanation, I found a reference. It is to Black’s Law Dictionary, 2nd edition. Here is the definition of “unalienable” from it:

The guy is making a mountain out of a molehill. Actually, he is making distinctions that are incorrect. The two words are considered to be synonyms. There is nothing nefarious about using one versus the other.

Both words come from the exact same root but just use a different prefix. And both of those prefixes, in- and un-, generally mean “not.” 

The root of both words is “alien,” not “lien.” Pronouncing either of them as in/un-a-LEEN-able is incorrect. (And the word “alien” is not the word “lien” with a prefix added. They are entirely separate roots.) Neither inalienable nor unalienable have anything to do with liens, and neither word derives from the root “lien.” So attempts to use “lien” to distinguish the two words are faulty.

John Adams, in making his copy of the Rough Draft, wrote ‘unalienable.’ Adams was one of the committee which supervised the printing of the text adopted by Congress, and it may have been at his suggestion that the change was made in printing. ‘Unalienable’ may have been the more customary form in the eighteenth century.”

So the two words were interchangeable even when the Declaration was written.

Inalienable in law appears to refer to “things” for the most part, with “certain” personal rights. But there’s wiggle room in there, which when dealing with the law, I don’t like. At all. ESPECIALLY when it is coming from the Supreme Court, because some lower court judge somewhere will use any “loophole” they can find to do whatever.

I don’t want any “right” enumerated in the Constitution subject to being “aliened.” Because they can’t be, they are given by God.

It seems clear that Thomas Jefferson preferred “inalienable,” while John Adams preferred “unalienable.” I think the terms were interchangeable even then. If not, there would have been discourse over the years about why the two men differed in opinion. I also think the terms became more narrowly defined in law over the years as evidenced by some of the definitions in Black’s, but that today they are synonymous.

At any rate, I think this:
• There is no hidden agenda to use one term over the other to trick people.
• A SCOTUS justice like Gorsuch is keenly aware of, and careful in his use of, legal terminology. His use of “inalienable” is evidence of what every source I’ve seen says: It is synonymous with “unalienable,” and “inalienable” happens to be the preferred spelling today..

Black’s Law 2nd Edition apparently disagreed. Did you look at their definitions of unalienable and inalienable? If they’re the same, why separate them?

If they’re not the same, why are they used interchangeably today? It is not some plot to deprive people of rights. I have no doubt that an argument to that effect would not hold up in court.

The second edition of Black’s was published in 1910. The 4th revised edition was published in 1968. Here is a comment about it, which I assume to be correct. A distinction was still being made then.

“Inalienable” appears to refer mostly to things (rivers and public highways are not rights), while “unalienable” refers to intangible rights.

The text of the Declaration of Independence:

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable rights, that among these are life, liberty, and the pursuit of happiness.

Those are intangibles.

The opinion of Justice Gorsuch, stated above:

“But the First Amendment stands as a shield against any effort to enforce orthodoxy in thought or speech in this country. It reflects instead a judgment that every American possesses an inalienable right to think and speak freely, and a faith in the free marketplace of ideas as the best means for discovering the truth…”

His use of “inalienable” would not make sense under that definition in Black’s. He is clearly referring to the kind of rights mentioned in the Declaration. He uses the term “inalienable” because it means the same as “unalienable” in its all-encompassing definition, and the two are synonymous today.

I would ascribe more knowledge and careful legal parsing to Justice Gorsuch than to some random radio host or to any of the people on the internet who think they’ve made an important discovery that is really nothing. The radio host, and anyone who thinks the “LEEN” pronunciation is significant or correct, is suspect on this topic because of the provable fact that they are wrong about the etymology.

I would say “Yes,” language is in retrograde: vocabulary is narrowing, and nuance seems to have been tossed overboard.

There is a slew of negations, both math/logic language and regular language, whether prefix or root.

In- (verse), un- (real), contra- (positive), a- (moral), re- (verse), con- (verse), de- (volution), anti- (matter), non- (sense), op- (posite), dis- (cover), and many more – especially “no,” “not,” “false,” and “zero” (which mathematicians STILL pretend is a number!).

It’s quite complex, with many subtle shades of meaning – and as far as I can tell, there isn’t yet a consonance between static math and dynamic language.

I personally believe the issue is the ease of pronunciation.

I have done some reading about this kind of thing, because some mispronunciations drive me crazy, like “nu-cu-lar” instead of new-clear for the word nuclear. And many people, even people whose job it is to speak publicly, do it.

The reason I have found is that there are more common words with the “sounds” of nu-cu-lar” than with “new-clear.” so the pronunciation is more fluid for people. And people tend to just fall into the “easier” way to say things.

For some reason, and I’ve seen this in several online discussions, people find it easier to say “inalienable” rather than “unalienable,” so one has “become” the other. But the fact that they are separated in old dictionaries tells me that they are not precisely the same word.

I do know that unless I’m concentrating on it, when I use the word in speech, like quoting the Constitution, I am more like to say “inalienable” myself! I have to make myself say it right. And regardless of what anybody says about it, I also like the “un-a-lien-able” pronunciation. If “language changes” as some say, then why this particular change would be so galling makes absolutely no sense to me.

I learned a lot of my vocabulary from reading books above my grade level. For some reason it is very difficult for me to sound out pronunciation. Possibly related to my life time struggle with auditory processing and auditory memory. Having to work twice as hard as everyone else to make spoken language make sense came in handy in college when assisting students where English was not their first language. Their accents were just another thing to deal with when trying to make sense of people’s words. Took me a long time to figure this out. I promise you, I will say nuclear the wrong way at least half the time. Sorry.

Lol, its ok. I was just fascinated to learn the ‘why’ of it for most people.

I had this wonderful black man as a high school social studies teacher. He could say “Portugal” just fine, but “Portuguese” came out “Pork-a-jeez” no matter what he tried! It was hilarious, he knew it was hilarious, and we had fun with it. We were very nice to him, partly because he was a Vietnam vet with multiple martial arts black belts, and we were a little afraid not to be!

I like the pronunciation too, and I still harbor a vestige of doubt in re the four words “inalienable,” “inalienable,” “alien,” and “lien.”

As far as the prefixes go, there *is* a difference between ‘un-‘ and ‘in-,’ even though they may be taken as synonymous today, and I prefer ‘in-‘ as being more powerful, more greatly negative. “In-AY-li-en-(uh)-ble” rolls better off the tongue – to my sonic taste! – than “unalienable” does.

Just my preference! I suspect that this topic qualifies as the greatest ‘beat the dead horse’ instance the Q-Tree has ever had!

4 Things To Know About SCOTUS Case That Could End Birthright Citizenship

The Supreme Court is set to consider a landmark case challenging President Donald Trump’s bid to limit birthright citizenship.

The case, known as Trump v. Barbara, is set for oral argument on April 1.

Upon entering office, Trump signed an order barring the children of illegal immigrants born in the United States from securing citizenship. It also applies to mothers on temporary U.S. visas who give birth in the country.

The order has been blocked by local courts pending the high court’s decision.

The justices are expected to wrestle with the meaning of the citizenship clause of the 14th Amendment. That part of the amendment reads, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Here are some of the key questions in the case and how they’ve been debated.

• What Does ‘Subject to the Jurisdiction Thereof’ Mean?
Much of the debate has focused on these five words from the amendment: “subject to the jurisdiction thereof.”
The wording of the 14th Amendment indicates that merely being born within U.S. borders is not enough for citizenship. That’s partially why the Supreme Court, in a 19th-century decision, said the children of foreign diplomats and those born in Native American territory do not receive citizenship.
One of the main questions before the Supreme Court is why and how these groups of people might differ from the children of illegal immigrants.
The American Civil Liberties Union, which is representing children and their mothers, has argued that people are subject to U.S. jurisdiction if they are obligated to follow its laws. Diplomats and Native Americans are excluded because they belong to other sovereign nations.
The Justice Department has focused more on the concept of allegiance, namely that illegal immigrant parents lack allegiance to the United States and therefore aren’t fully subject to the country’s jurisdiction.

• Did the Supreme Court Already Decide This Issue?
Last year, the Supreme Court issued a landmark decision lifting several blocks on Trump’s policy, but did so in a limited way. That decision, known as Trump v. CASA, only clarified how far judges could go in blocking the president.The current case is inviting the justices to delve deeper into the 14th Amendment and one of its much older decisions from 1898. In United States v. Wong Kim Ark, the Supreme Court held that the 14th Amendment guaranteed birthright citizenship to a Chinese man whose parents were permanently domiciled in the United States.
Many federal judges have cited that decision to say that the Supreme Court already said the 14th Amendment granted citizenship to people born on U.S. soil—including those born to illegal immigrants.
When the U.S. Court of Appeals for the Ninth Circuit ruled on Trump’s policy, it pointed to a portion of the 1898 opinion that identified three exceptions: children of Native American tribes, those “born of aliens in hostile occupation,” and “children of diplomatic representatives of a foreign state.”
The Justice Department argued instead that the 19th-century decision applied only to children whose parents were domiciled, or residing with some kind of allegiance to the country.
It noted that the court repeatedly referred to domiciled status. For example, the majority opinion read, “Every citizen or subject of another country, while domiciled here, is within the allegiance and the protection, and consequently subject to the jurisdiction, of the United States.”
Another portion of the opinion said that Chinese persons owed allegiance to the United States and were entitled to its protection “so long as they are permitted by the United States to reside here.”
It’s unclear how the six conservative justices will rule, but the three liberal justices have already said in an opinion last year that Trump’s policy was “unquestionably unconstitutional.”

• What Did Congress Intend When It Proposed the 14th Amendment?
The 14th Amendment was ratified in 1868 against the backdrop of the Civil War and the Supreme Court’s decision in Dred Scott v. Sandford, which held that slaves were not citizens.The Justice Department said the United States overturned that decision with the 14th Amendment and the Civil Rights Act of 1866. That law specified that persons born in the United States, “and not subject to any foreign power, excluding Indians not taxed” were citizens.
That law and statements from members of Congress will likely bear on the Supreme Court’s decision-making, as many of the justices have been viewed as originalists, or giving especially strong weight to the nation’s history.
The Justice Department pointed to, among other things, what Sen. James Wilson of Iowa said about the Civil Rights Act of 1866.
At the time, he said, “We must depend on the general law relating to subjects and citizens recognized by all nations for a definition, and that must lead us to the conclusion that every person born in the United States is a natural-born citizen of such States, except … children born on our soil to temporary sojourners or representatives of foreign Governments.”
The ACLU said that Wilson’s comment was incorrect and conflicted with English common law, which has been cited in legal decisions such as Wong Kim Ark.
In a briefing to the Supreme Court, the ACLU cited English legal scholar William Blackstone. Writing in his “Commentaries on the Laws of England,” Blackstone said, “Natural allegiance is such as is due from all men born within the king’s dominions immediately upon their birth.”

• Is Trump Violating Federal Law?
The ACLU and congressional Democrats have argued that outside of the 14th Amendment, Trump is also violating a federal law passed in the 20th Century.
The Immigration and Nationality Act of 1952, and its predecessor, known as the Nationality Act of 1940, used the 14th Amendment’s phrasing. It states in part that “the following shall be nationals and citizens of the United States at birth: a person born in the United States, and subject to the jurisdiction thereof.”
A long list of congressional Democrats filed an amicus, or friend of the court, brief telling the Supreme Court that regardless of what the 14th Amendment meant, Congress interpreted it as giving citizenship to the children of illegal immigrants when it enacted the 1952 legislation.
Because that was the lawmakers’ intent when they passed the bills, Democrats argued, the 1952 law was an independent reason to reject Trump’s executive order.
The administration argued that because the laws were transplanting language from the 14th Amendment, the original meaning of the amendment—not how Congress interpreted it—should rule.

Legal scholar Ed Whelan speculated that the Supreme Court might focus on the Immigration and Nationality Act but refuse to rule on the meaning of the 14th Amendment.

My guess is that the Chief will be part of a supermajority of the Court that rules that the [executive order] violates section 1401(a) and that declines to address the constitutional question,” he said in a post on X.

Neama Rahmani, a former federal prosecutor who worked on immigration issues, disagreed.

“Although courts, including the Supreme Court, avoid constitutional rulings when cases can be decided on narrower statutory grounds, the [Immigration and Nationality Act] mirrors the language of the 14th Amendment, so the justices are unlikely to rely on statutory authority alone,” he told The Epoch Times.

A seven-month old baby girl has died after being fatally shot in a New York City street by a scooter-riding suspect, police said. 

The unknown child was hit while being pushed in a stroller near Humboldt and Moore Street in Brooklyn on Wednesday, sources told AM NY.

Shots rang out just before 1:25 pm, with the mother discovering after that the child was bleeding from the head after seeking refuge in a nearby bodega.

Images have since emerged of the two suspects wanted in connection, one of whom is sitting on the back of a scooter while holding a firearm. 

The child was rushed to Woodhull Hospital, also in Brooklyn, where she could not be saved and was pronounced dead shortly after.

One woman who was inside the facility described the horror as the child was brought in, saying: ‘I was in the hospital when the father brought the baby in.

‘The dad brought the baby in. The dad was screaming, ‘Save my baby!’ And the mother was screaming at the top of her lungs.’

A manhunt is now underway for the two suspects, the moped they were using was found ditches a few streets away from the scene. 

NBC New York’s chopper captured images of the street in the aftermath, with crime scene tape covering the area which was swarmed with officers.

President Trump’s solicitor general made the so-called ‘smartest’ liberal Supreme Court Justice look like a complete fool after she tried to school him on the 14th Amendment and birthright citizenship.

…During the hearing, Kagan tried to corner Solicitor General John Sauer for agreeing with Justice Alito that birthright citizenship should not apply to children of illegal aliens.

Kagan went on to say that historical texts, including the Constitution, do not support Sauer’s argument that the term “jurisdiction” requires complete allegiance to the United States rather than to foreign powers.

A growing contingent of the scientific community has become skeptical about the body of research finding that microplastics have infiltrated almost every aspect of nature, from the remotest regions of Earth to inside our bodies.

As The Guardian reported earlier this year, scientists have started warned that some of these studies may be based on errors due bad methodology, inadequate efforts to limit plastic contamination, and lack of validation.

Now, researchers from the University of Michigan have found that the special coating on commonly used nitrile and latex gloves worn by scientists could be causing measured levels of microplastics to shoot through the roof, even though the coating isn’t technically made of microplastics itself.

As detailed in a recent paper published in the journal Analytical Methods, special substances added to disposable gloves to make them separate from molds more easily, called stearates, are chemically very similar to microplastics, making them almost impossible to distinguish in the lab.

However, the research team led by recent University of Michigan doctoral graduate Madeline Clough stressed that the findings aren’t the last word on the question.

“As microplastic researchers looking for microplastics in the environment, we’re searching for the needle in the haystack, but there really shouldn’t be a needle to begin with,” she said in a statement.

For a preceding project exploring airborne microplastics, Clough used special air samplers to collect environmental samples and analyzed them using light-based spectroscopy. The air samplers themselves feature metal surfaces that collect any chemicals present in the air.

While preparing these metal surfaces, Clough wore nitrile gloves, as is standard practice. But when she analyzed the results, she found the number of microplastics was orders of magnitude higher than she expected, inspiring their latest paper.

“It led to a wild goose chase of trying to figure out where this contamination could possibly have come from, because we just knew this number was far too high to be correct,” she said in the statement. “Throughout the process of figuring it out — was it a plastic squirt bottle, was it particles in the atmosphere of the lab where I was preparing the substrates — we finally traced it down to gloves.”

Beyond nitrile gloves, the team tested seven other types of gloves as well for their latest paper, and found that cleanroom varieties — which do not come coated in stearates — performed significantly better than others, resulting in fewer particles getting caught in the air samplers.

“The type of contact we tried to mimic touches upon all varieties of microplastics research,” Clough explained. “If you are contacting a sample with a gloved hand, you’re likely imparting these stearates that could overestimate your results.”

Under an electron microscope, the researchers struggled to tell apart polyethylene, an extremely commonly used plastic, from stearate particles.

But while the results suggest previous studies could be painting a highly skewed picture of microplastics contamination in the world around us, Clough suggested it’s not too late.

“For microplastics researchers who have these impacted datasets, there’s still hope to recover them and find a true quantity of microplastics,” she said in the statement.

“By using this approach in conjunction with our included spectral libraries of stearate standards, researchers can address glove-based contamination in environmental datasets and provide more accurate estimates of environmental microplastic abundance,” the researchers conclude in their paper.

In short, it could take quite some time until we know for sure just how pervasive the small pieces of plastic are in the environment, let alone their effects on our health.
