There is a simple solution to this problem,  

It is in no way “simple.”

and it is what we were all promised.

The promise is being kept.

Trump controls immigration and deportation. 

It is much more complicated than that statement indicates. The Executive branch has been delegated authority by the Legislative branch and is also beholden to the Judicial branch.

As the Supreme Court has explained, it is a “basic proposition that all orders and judgments of courts must be complied with promptly.” Courts can — and often do — step in when their rulings are defied.

…Courts have several important tools available to enforce their orders, including contempt proceedings and attorney sanctions.

…There are two types of contempt proceedings, civil and criminal, both of which can result in sanctions, fines, and in extreme cases, jail time. Federal courts have broad discretion to determine whether a party is in contempt of court…

Civil contempt is primarily remedial…For instance, a civil contempt order might impose a daily fine that accrues until an order is complied with, such as in 2022, when a New York state court held President Trump in civil contempt and fined him $110,000 in total — $10,000 a day for each day his legal team failed to submit explanations for not turning over documents.

Criminal contempt requires increased procedural safeguards and is intended to punish a disobedient party, and unlike most civil contempt penalties, the defendant can’t take action to avoid punishment. However, the president has the power to pardon those convicted of criminal contempt. 

…Although federal courts have never held a sitting president in contempt of court, they have used the power to compel action by and punish government agencies, officials, and civil servants responsible for carrying out government actions.

Does anyone doubt that the Left would imprison PDJT by means of criminal contempt proceedings if they could find a way to do it?

The remedy [for not obeying court orders] is contempt, whether civil or criminal.

“Of course, for criminal contempt, the president can pardon those accused or convicted. For civil contempt, it can be fines or jail until the order is complied with. But it is the United States Marshals, who are part of the Department of Justice, that enforces civil contempt.”

[Professor] Geoffrey Stone…agrees.

“If the executive branch flat-out refuses to comply with court orders and refuses to prosecute government officials for violating the law, I’m not sure what else the courts could do,” Stone says. “It would be a constitutional crisis of unprecedented proportions.”

…Ultimately, Garnett says that the best way to deal with an executive who refuses to follow the law is through political means.

“At the end of the day, in our system, the main checks are going to be political; that is, if Congress thinks a president is wrongly not complying with court rulings, they have mechanisms (defunding things, possible impeachment!),” Garnett writes in an email. “Similarly, if We the People think a president is wrongly not complying with court rulings, we can vote him or her (or his or her political allies in Congress) out of office.”

All of this is what we’ve seen play out. Whenever possible, Pres. Trump has been sanctioned, impeached, fined, and held in contempt.

I have no doubt that he wants to avoid a Constitutional crisis, or even a protracted battle over sanctions and contempt charges, because of everything else going on and because it would hamper his overall efforts to make America great again. Political battles of this kind rally the Left and obstruct him and his administration, preventing them from doing other important work. That does not mean doing less than possible regarding immigration. It might mean avoiding judicial battles that would definitively curb a president’s power over immigration, now and in the future.

Faced with the extreme conditions that were allowed to proliferate by past administrations, he has done more than any president regarding deportation, enforcing the laws, securing elections, etc.

He has allowed judges without the Constitutional authority to do so to undermine that authority.

Pres. Trump has a crew of lawyers, both personal and governmental, who no doubt advise him on decisions regarding judicial orders. And all of that has to be balanced with domestic policy goals; foreign policy; elections; protecting himself as the holder of the office of president, who has a duty to “preserve, protect and defend the Constitution of the United States”; and timing.
