Constitutional attacks on 18 U.S.C. § 1752 would most likely fall in two categories–vagueness or violation of the First Amendment.
Allegations of vagueness should be overcome by the formal designation of the buildings and grounds that are subject to the regulations published in the Federal Register. In addition to appropriate signs providing notice of a temporary residence or of a restricted area, the Secret Service will endeavor to post personnel in appropriate locations to give verbal notification to persons seeking to enter without authority or otherwise act in violation of the statute, to meet the special problems of notice in restricted areas. Peaceful assembly where the President or the President’s office is located will still be permitted. Presidential security is conducted pursuant to Federal authority, and thus does not depend upon differing local ordinances.
The basic legal theory underlying the provisions of this statute is that of trespass. The government has the right to control presence on government property, and physical presence on the designated grounds is clearly covered by regulations. Since demonstrations involve conduct, they are subject to reasonable regulations when necessary to protect other legitimate government interests. See Cox v. Louisiana, 379 U.S. 559 (1965). Even-handed application of a precise and narrowly drawn regulatory statute should pass constitutional muster. See Edwards v. South Carolina, 372 U.S. 229, 236 (1963). See also Shenck v. Pro-Choice Network, 117 S.Ct. 855 (1997) at 868-869, (upholding fixed buffer zones to permit ingress and egress at an abortion clinic).
Section 1752 of Title 18 is aimed at specific categories of knowing and willful conduct, and 18 U.S.C. § 1752(a)(1) is far more circumscribed than the general trespass statute upheld in Adderly v. Florida, 385 U.S. 39 (1966).
First Amendment objections may be raised as to the validity of 18 U.S.C. § 1752(a)(2) which outlaws the intentional disruption of government business at designated residences and offices.

And it is clear to us that in arresting, convicting, and punishing the petitioners under the circumstances disclosed by this record, South Carolina infringed the petitioners’ constitutionally protected rights of free speech, free assembly, and freedom to petition for redress of their grievances.
It has long been established that these First Amendment freedoms are protected by the Fourteenth Amendment from invasion by the States. Gitlow v. New York, 268 U.S. 652 ; Whitney v. California, 274 U.S. 357 ; Stromberg v. California, 283 U.S. 359 ; De Jonge v. Oregon, 299 U.S. 353 ; Cantwell v. Connecticut, 310 U.S. 296 . The circumstances in this case reflect an exercise of these basic constitutional rights in their most pristine and classic form. The petitioners felt aggrieved by laws of South Carolina which allegedly “prohibited Negro privileges in this State.” They peaceably assembled at the site of the State Government 10 and there peaceably expressed their grievances “to the citizens of South Carolina, along with the Legislative Bodies of South Carolina.” [372 U.S. 229, 236] Not until they were told by police officials that they must disperse on pain of arrest did they do more. Even then, they but sang patriotic and religious songs after one of their leaders had delivered a “religious harangue.” There was no violence or threat of violence on their part, or on the part of any member of the crowd watching them. Police protection was “ample.”

Happen the stated reasons were not the actual ones why they needed him gone, but just chosen as sufficient to get the job done.
I could make that jacket…the fabric is by necessity flame retardant. (Can’t have a devil burning off his clothes in public.) The coat has a lot of padding to enhance his physique so we do not notice the shriveling of him over the years. (he cannot appear diminished in any way) and it disguises some bullet proofing underneath. the shoulders are exaggerated to hide the hobbit within, but that is easily accomplished with foam stabilizer. (stabilizer is extremely lightweight giving the appearance of strength though. I use it for bunny ears.)

it’s great! i made 6 inch bunny ears to attach to a headband–they stayed perfectly straight up. and they are lightweight. The original use was for bags–shopping bags, gym bags or whatever because it holds it’s shape beautifully. Easy to sew on a sewing machine as well. and it soft, so it won’t irritate the ponies.

JMO – Not to offend the science oriented on here, but that is one of the major ways they bend it along with the medical industry. The industry noted experts promote a theory of theirs as a building block fact that is based on other sets of universally accepted facts; which may or may not actually be facts.
The problem is the “believers” in the general public then carry the torch for them and promote it. That is until a related truth is “discovered” or the “fact” gets exposed some time later with far less media and industry fanfare. When forced to acknowledge it is nearly always with a “We thought X, but we have since learned Y.” in all knowing expert tones.
So, a fact is a fact until proven otherwise if you are a noted expert or government official. People buy and promote that shiz all of the time. They are rarely called out for it.

I ran across this in my reading this morning and I am passing it along. It is not so much for discussion as for reflection and meditation on the question that the author raises. “What does it mean when we say that God forgives us?” I suspect there are many ways to think about that question. Since we are still, basically, in the afterglow of Easter I thought its relevance was apparent.
Once, Jesus directly asked God the Father to forgive; to forgive those who were murdering him (Luke 23:34). It seems most unlikely that any early Christian would have created those words and attributed them to Jesus, so this is one case where skepticism seems unwarranted and we may take the words to reflect something of what Jesus believed about forgiveness. Once again, however, we have come to a text that raises many questions for us. It is one sentence in the midst of the extended narrative of Jesus’ trial and crucifixion, and the context offers nothing to help us interpret it. The interpreter must begin with some very basic questions: Did Luke write it? Did Jesus say it? Then we shall move to some that are very profound.
The question of Lukan authorship would not arise if it were not that the sentence is missing from some of the earliest and most reliable manuscripts. That scarcely settles the matter in favor of it being a later addition, however, for it is present in other very early and reliable manuscripts, so one must consider whether it is more likely that an early scribe omitted the sentence or whether one added it. Raymond Brown has surveyed the discussion in a most helpful way and argues, as do many other commentators, for its originality (1994, 979–80). It is suggested that, given the hard feelings that existed between Jews and Christians from the second century A.D. on, there were some who could not believe that Jesus had forgiven the Jewish leaders for plotting his death, so the verse was dropped from some manuscripts. It seems far less likely that those early Christians would have wanted to invent a saying that claimed Jesus forgave either Jews or Romans. Given the special interest in forgiveness that we have found in Luke it seems sound to conclude that the verse was part of the original Gospel.
As to whether Jesus himself said it, once again, caution seems appropriate. All four Gospels tell us that followers of Jesus were present, watching the crucifixion from a distance, so Luke could have heard of this saying from one who was there, but this is a possibility, not a certainty. It is essentially a very shocking saying, however. Why should those unrepentant people, whoever they were, be forgiven? As such, it is in keeping with other shocking sayings of Jesus—“Love your enemies,” “If anyone wants to sue you and take your coat, give your cloak as well” (Matt 5:44, 40)—so it seems more likely that these words came from him than from anyone else. They should be of special importance, then, but what do they mean?
Serious questions: First, who were “they,” whom Jesus asked the Father to forgive, since they did not know what they were doing? The discussions focus on the Roman soldiers and the Jewish leaders. Two opinions: Calvin said that Jesus had pity on the Jewish people and the soldiers because of their ignorance, and interceded for them, but that it would have been in vain to pray for the scribes and priests. But Joseph Fitzmyer would exclude the soldiers, since they are not mentioned explicitly until v. 36 (1985, 1503). Is there any way that we can identify “them”? What limits might there have been on Jesus’ mercy? Let us begin at the cross and work backward; to see where readers think they must stop.
The soldiers: They did not know what they were doing, in executing an innocent man, for Jesus had been condemned to death by the governor. As far as they knew they were exacting justice, and there would have been little or nothing in their experience to teach them that inflicting such pain on anyone was wrong. What they did was wrong, but the one they tortured might ask God to forgive them.
The bystanders who mocked him: They had no excuse for such behavior, but the evangelists want us to know that in their ignorance they spoke the truth. “He saved others; he cannot save himself” (Mark 15:31). They obviously enjoyed their cruelty. Would Jesus have prayed for them?
Pilate: He knew what he was doing, but only partly. He knew Jesus was the source of trouble in Jerusalem, or potential trouble, and keeping the peace was all that mattered for him. He was willing to condemn to a terrible death a man whom he decided was innocent of any crime (Luke 23:4, 14–15, 22). But he did not know who Jesus really was. Was he included in Jesus’ prayer?
The priests: I believe that they also saw Jesus as primarily a political danger, likely to stir up trouble with the Romans. As Jews who knew their law they might have had serious qualms of conscience about seeking the death of a man for those reasons, but John claimed to know how they reasoned, quoting the high priest Caiaphas as having said, “… it is better for you to have one man die for the people than to have the whole nation destroyed” (John 11:50). Here, also, he spoke more truth than he realized, for this one man died for the people in a way Caiaphas could not have foreseen. Unless they truly did believe the charge of blasphemy, which was subject to the death penalty in Jewish law, the guilt of the priests seems heavier, for their standards were different from those of Pilate and the soldiers, and they had a greater potential for understanding Jesus, but in fact they did not understand him, and did not realize all that they were doing.
Peter and the Ten: They did not fully understand Jesus, either, and they were just weak, without courage enough to try to help their friend. They also needed forgiveness. But here is something different. John records a scene in which the Risen Christ evidently forgave Peter (John 21:15–19), and in none of the resurrection appearances does Jesus refer to the ways his disciples had failed him.
Judas: The way to the cross began with him, and did Jesus ask forgiveness for Judas? We do not know why he betrayed Jesus, so will not use space to discuss the various theories. All that Luke can tell us is that Satan entered into Judas (Luke 22:3). According to Matthew, however, he also did not know what he was doing, for when he saw that Jesus was condemned he repented, saying, “I have sinned by betraying innocent blood” (Matt 27:4). He is the one person in all this cast who is said to have repented. Did Jesus pray for his forgiveness?
The discussions of Jesus’ prayer usually refer only to the soldiers and the priests (sometimes also the people), but I thought that reflection on what Jesus meant by forgiveness ought to be more inclusive, for there was a lot of guilt involved with his death. We cannot answer the questions asked above, for we cannot get into the mind of Jesus, but asking them leads us to reflect on what forgiveness really means, and this leads to more questions.
Calvin’s concern for upholding the justice of God leads us to wonder whether he thought Christ’s prayer was not answered. “For when Christ was moved by a feeling of compassion to ask forgiveness from God for his persecutors, this did not hinder him from acquiescing in the righteous judgment of God, which he knew to be ordained for reprobate and obstinate men.… Yet knowing that God would be an avenger, he left to him the exercise of judgment against the desperate.” He seems to find in the passage Christ’s merciful feelings, but not true forgiveness.
Suppose “they,” whoever they may be, really were forgiven, then let us ask our next question. What would forgiveness have meant for any of them? The only people we know of who were forgiven in the sense that we found in the work of the most perceptive of the Old Testament authors were the Eleven (and perhaps also those priests mentioned in Acts 6:7, but we know nothing more of them). Peter and the others were not held accountable for their failure, according to the resurrection narratives. Their relationship with Jesus was restored and they were personally transformed. Come to think of it, was that why their earliest preaching focused on forgiveness? They had been forgiven, but we will leave the question open, for the resurrection texts and the Acts sermons do not explicitly say that.
What could forgiveness have meant for the others on our list? Judas was dead, and there is no evidence that many of the others ever had a relationship with the Risen Christ, or even knew that they needed to be forgiven. Calvin does remind us of the Jewish people who became followers. The question as to what forgiveness meant in this and the preceding stories we have considered is seldom asked, probably because it is assumed that it meant remission of punishment after death, at the Last Judgment. If Judas, and even Pilate, may have been included in Jesus’ prayer (and not everyone may agree with that), then what else could forgiveness mean?
Or, let us ask it about the paralytic and the sinful woman, whom we know to have been forgiven. Did it refer only to judgment after death, or did it change them, as the Old Testament authors hoped forgiveness would do? The stories did not tell us, and although the Gospels refer to the Last Judgment they do not say much about forgiveness in connection with it.

To answer your question first: I consider anything (thought or clarification) that I had not considered previously as potentially helpful. Not so much that it gets me closer to a particular truth but more that it allows me to realize that, as Paul said, I see some things through a cloudy haze and there may be more to a proper understanding than I thought. After many years of following Christ I have found that many of my earlier “certainties” were based on assumptions the implications of which were not fully understood. I have been overwhelmed over the last couple of years of what the Sermon on the Mount actually means in my Christian walk. If I take the words of Jesus seriously, and I do, the expectations of discipleship demand deep and persistent reflection. Reading the works of others who have thought about these things gives me a foundation for further understanding. If you are reading the Sermon on the Mount and you come to the last verse in Chapter 5 it should lead to some sober thinking.

Yesterday I was trying to find some evidence that the Kristi Noem purse-snatching even happened.
All I could find was a story by CNN, with “sources” and Secretary Noem’s own account, filtered through police and DHS “sources”.
Why don’t the official sources have names?
The first question when something like this happens would be, was there a camera?
We were told right away that there was a camera. The obvious next question would be, “where is the footage from the robbery?”
It was not addressed in updates to the story, the updates just gave more detail as to what was in the purse, such as the brand name of the wallet.
If I wasn’t already suspicious about this (I was), seeing no mention of any release of a photo, and no comment yet from the restaurant, my doubts increased.
Just a little while ago, I got on the computer to see whether I was just being foolish. Certainly there would be a picture of the man by now, so the public could help identify him, right?
I found this. Obviously others have been asking where are the pictures too. Maybe they’re on Pam Bondi’s desk.

What the heck? Why is what the thief looks like a big secret? What’s with all the anonymous “sources”?
I have looked at reports that say the Secret Service is trying to track down the thief, but when I watch the video there isn’t anything from the Secret Service. just reporters saying what they’ve been told from “sources”.
Does anyone else have anything more concrete?
I have two theories:
1) Police often resist engaging the public in searches for criminals, simply due to the enormous number of “false positives” they receive. In this case, can you imagine how many MALICIOUS false reports leftists would generate?
2) The video shows something the Secret Service doesn’t want the public to know, either about their competence or their methods of protection.

Hey guys, I wanted to share a situation we discovered yesterday at my son Josiah’s Liver Transplant clinic visit. First the good news. We’d run out of his long term BP med Lisinopril (he’d been taking 40mg for years) about a month ago & being in the midst of taxes I hadn’t gotten him to the local doctor for refills. Anyway at the clinic yesterday his BP was 127/73 which the tech called “great” so I’m hopeful he may no longer need that med!
Anyway he got a blood draw for his routine labs just before seeing the “doctor” (we actually saw the PA as the doc was on leave for his daughter’s wedding). I had also dropped the ball on getting an interim blood draw about 3 months after the last clinic visit so yesterday’s labs were all they had to go on besides the lab work 6 months ago for “recent” trends. His Alkaline Phosphatase has remained pretty high for a while now. It’s been ranging between about 150 & just shy of 200 when it’s supposed to be under 116.
Combining that with the fact that a baseline MRI done after the last clinic visit, to establish liver imagery & also to potentially substitute for biopsy procedures going forward, revealed some concerning aspects to his liver status. They strapped some type of vibrating device around his abdomen that measured the liver’s softness or hardness & based on that data his liver has some degree of Fibrosis.
They also imaged the biliary structures & in the place where the transplanted liver’s “biliary tree” (I think that was the term) was sutured to his body (a connection into the intestines) there is a narrowing of that opening causing a potential congestion point for the bile & causing elevated Alkaline Phosphatase. We are returning to the hospital Today for a Liver ultrasound to get more recent imagery. I don’t recall him ever getting a liver ultrasound other than the one that imaged the dozens & dozens of masses in his original liver, prior to transplant, so am not sure what to expect here. I guess I’m glad that this is not typically part of the routine process like his echocardiograms are 🙂
Also in less that 3 weeks he has been scheduled for an ERCP, iirc, procedure, expected to take about 4 hours under general anesthesia. They will be threading a wire down through the esophagus & down into the liver to get to that narrowing place where they will deploy a “balloon” to expand the tube. They also may snatch a biopsy to get more detailed views of concerning tissue areas.
I guess I’d like prayer for Josiah & his liver & that these appointments will go well & reveal all areas of his liver that need intervention. Ideally I would hope the ERCP procedure would be problem free, not that we discussed potential complications with the PA. This is new territory for us in that such an intervention has never been proposed before. Perhaps this situation is still part of the fallout from the Transplant Rejection he experienced when we were unable to obtain the prescribed amount of Prograf/tacrolimus he needed during the early part of the covid crimes era when many meds suddenly went into a scarcity scenario. When he was hospitalized then in May of 2000 the one doctor had remarked that “we almost lost the liver”. Continuing fallout from the Covid Memoirs scenarios that PAVACA requested we share (& I have yet to articulate) a while back 🙁
He continues to show good liver function numbers, thankfully. However he has not yet returned to the pre-rejection dosages of meds. Prior to rejection he took a total of 2.5mg of Prograf but he is at 4mg still now. He remains on 2000mg Cellcept & 1200mg of Ursadiol, daily, divided doses every 12 hours. He’d had Cellcept in the early post-transplant phase but not until the rejection bout did that med come back on the scene. Ursadiol was added sometime after the rejection situation (it’s supposedly a very safe med at least) to help improve some liver functioning. We’d hoped to decrease meds or doses but that discussion will wait until after the ERCP procedure pending a hopefully positive outcome…sigh….

A cycle trader I watch on yootoob has been saying for weeks that the expected next cycle low in gold is on or around May 7th, so from his perspective gold should be heading down until then (the closer we get to the 7th without heading down, the steeper the decline should be as we approach the 7th), before going back up with the beginning of the next new cycle.
It just so happens that the stock market cycle is expected to bottom at or around the same time.
So we’ll see. It’s not a perfect system, it’s a market so anything could happen, but it is fascinating how predictable cycles make the market appear to be over extended periods of time, when they are back-tested.

We’re back with more changes at DOD, and this time, an update on COVID-19 and reinstatement. We all know that the previous administration issued unlawful orders on mandatory vaccines—on an experimental vaccine, COVID-19. You know it, we know it.
We’re doing everything we can, as quickly as we can, to reinstate those who were affected by that policy. It hasn’t been perfect, and we know that. We’re having an ongoing conversation with you to get it right, working with the White House as well.
We want anyone impacted by that vaccine mandate back into the military—people of conscience, warriors of conscience—back in our formations. We hear you, and we’re working to get updated guidance as quickly as possible. So here’s where we are on more guidance we’re providing right now.
In January, the President issued his executive order. We jumped right on it. In February, I directed the Department to take corrective action regarding this specific Department’s unfair, overbroad, and unnecessary COVID vaccine mandate. We apologize. Apologized then, apologize now for how it was done, and we want to fix it.
So today, I’m signing a memorandum that directs the Undersecretary of Defense for Personnel and Readiness to provide additional guidance to the boards that are reviewing these cases—concerning the review of requests from service members and former service members adversely impacted by the COVID-19 vaccine mandate.
The guidance also will facilitate the removal of adverse actions on service members solely for refusing to take the COVID-19 vaccine, including discharge upgrades and less-than-fully-honorable discharges for individuals separated for refusing to take the COVID-19 vaccine. We’re trying to scrub all that, clean all that up.
We’ll also facilitate appropriate remedies for service members who have suffered additional career setbacks resulting from the previous administration’s unlawful vaccine mandate. That original EO addresses the unfair, since-rescinded COVID-19 vaccine mandate imposed on warfighters during the previous administration.
We know how bad it was. You know how bad it was. And through this guidance—which I encourage you to check out directly, because it’s an update going even further than what we’ve done in the past—this memo is providing supplemental remedies for service members and veterans negatively impacted by the DOD’s defunct COVID-19 disease vaccine mandate.
So, more guidance here that we think is really important to getting this right, and we welcome you all back as quickly as possible.

During the height of her father’s presidency in 2023, Ashley Biden launched a walk-in trauma recovery center in Philadelphia equipped with infrared saunas to help women overcome mental health challenges. Known as the Women’s Wellness Spa(ce), the former first daughter’s charity supposedly got off the ground with at least $500,000 in seed funding in 2023. Meghan Markle and Prince Harry’s Archewell Foundation and the Silicon Valley Community Foundation each reported in their tax forms granting $250,000 to Ashley Biden’s charitable venture in 2023, figures that should have been reflected in the Women’s Wellness Spa(ce)’s Form 990 tax filing.
But the Women’s Wellness Spa(ce) told a much different story to the IRS, reporting in its 2023 tax filing that it received just $170,296 from all sources that year, and that it didn’t receive any contributions from a single source greater than $5,000, seemingly contradicting the financial reporting of its two largest benefactors. Ashley Biden signed the document as the charity’s president under penalty of perjury.
To Paul Kamenar, an attorney with the National Legal and Policy Center watchdog group, the documents show that Ashley Biden’s charity clearly violated IRS rules by failing to disclose $500,000 in contributions it received in 2023. Kamenar filed a complaint on behalf of the watchdog group on Monday demanding the IRS audit the Women’s Wellness Spa(ce) to discover if it failed to report any other grants in 2023 and possibly impose sanctions upon the former first daughter for violating the agency’s financial disclosure rules.
“Ashley Biden’s failure to disclose to the IRS receiving $500,000 in grants in 2023 raises the question of what other contributions is she hiding,” Kamenar told the Washington Free Beacon.
